RESOLVED – That permission be GRANTED in accordance with the recommendation of the Chief Officer Economy and Planning as set out in COEP/32/24 and Note 1 below. Note 1 - That the decision to grant be delegated to the Chief Officer Economy and Planning once NRW and Welsh Water were satisfied with proposals for the drainage/ phosphorous and a hydraulic modelling assessment had been undertaken and agreed to their satisfaction.
The Development Management Lead introduced the report and in doing so drew members’ attention to the addendum, particularly the comments from Highways relating to the mitigation of the Gresford interchange, he also advised members of the following points: · The application was before committee as it proposed a major development · The application was for outline planning permission, with all matters reserved except for means of access, for the erection of up to three warehouse and distribution units (B8 use class), together with ancillary office accommodation, totalling up to 93,019 sq. metres net floor space, service yards, car parking, HGV parking, internal circulation, landscaping and ancillary works. · Full planning permission was sought for the demolition of existing structures on the site, means of access, earthworks, drainage, landscaping and the creation of an ‘ecology zone’ within the easternmost areas of the site, to include ecological mitigation measures and ancillary works. Acknowledgement that a number of concerns had been raised by local residents, including the following: · Concerns relating to the design, height and appearance of the proposed buildings · Ecological impact · Visual Impact · Noise pollution · Traffic concerns The Development Management Lead conformed the following points: · Whilst it was acknowledged that the building was taller than others in the area, the height of the building would be considered at reserved matters stage if this application was approved. The proposed buildings could be comparable in height to other buildings on the wider area of the industrial estate · The proposed ecological mitigation area which was considered acceptable, benefitted from a separate planning permission · The visual impact is deemed acceptable and landscaping would be considered at reserved matters stage if this application was approved. · No objections had been raised by Highways subject to proposed off-site improvements being secured through conditions and Highways Agreements · No objections raised by the Contaminated Land Officer and the Public Protection Officer, subject to a number of conditions The local ward member (Councillor Michael Morris) spoke in relation to the application and was pleased that there was now a full suite of conditions to consider. He did however raise the following points; · Concern in relation to the site access onto Bryn Lane, which a previous report had stated would benefit from improvements. · Clarity sought on the requested Section 106 Agreement for the A483 roundabout, was there a need for similar request for contributions to the other roundabouts in the immediate area? · Disappointment that consideration had not been given to the potential impact that would be created by an increased volume of traffic on Ridley Wood Road. The road is used as a shortcut to and from the industrial estate and was extremely busy at certain times of the day. Suggestion was made that Highways could look at enforcing a continuation of the weight restriction that ran through a section of the road. Suggestion that Highways could look at implementing a continuation of the weight restriction currently in place on the B5130 from Chester to the A534 junction at Farndon · Concern was also raised in relation to the bus route which did not cover a wider area of the Industrial Estate · Suggestion made that officers visit the site and ensure that any recently commenced works on the ecological area are not commenced until discharge of conditions, particularly in relation to access. The Development Management Lead responded to the local member’s concerns: · Confirmation given that the Section 106 for roundabout improvements related to the signalisation upgrades at the Gresford roundabout. Any other upgrades and works would also be subject to a Highways Agreement. · In relation to Ridley Wood Road the implementation of weight restrictions would be with the Local Highway Authority if they felt it would be necessary, · The matter of recently commenced works on the site would be addressed The Highways Officer confirmed the following: · The Section 106 contribution requested from the applicant was for use towards the next upgrade to the signals on the Gresford roundabout, including the addition of a system called MOVA. · Discussions had taken place regarding the introduction of a 30mph speed restriction throughout the Industrial Estate. · Consideration could be given changes relating to Ridleywood Road including weight restriction · The main site access would benefit from a crossing facility which was being considered. · Discussions were in place for an improved bus service that reached this area of the Industrial Estate A discussion ensued and Members raised the following points: · Concerns relating to the loss of trees and hedgerows · On a positive note there was recognition that the development would provide employment in the area and that we should encourage new business growth on Wrexham Industrial Estate · The loss of trees would be dealt with as part of the final form of the landscaping and layout schemes · Assurances were sought regarding Contaminated Land and PCB’s. Were we are making sufficient progress and had soil testing taken place? · Foul drainage and Phosphorus - would there be adequate capacity to connect to the public sewerage system. · It was intended that the proposed development would connect to the public sewerage system although in the event that there would be insufficient capacity a Hydraulic Modelling Assessment would be required. · The Contaminated Land Officer had been consulted and confirmation had been received that they had noted and accepted the information, if they required further information it would be requested. An amendment for deferral was submitted and seconded. The amendment to defer was put to the vote and was lost.

The Head of Development Management introduced the report which was a resubmission of a scheme that had previously been submitted. The application for the erection of a freestanding restaurant with drive thru facility, car parking, landscaping and associated works within part of the existing Plas Coch Retail Park car park. · The building would be situated in a prominent position adjacent to the entrance to the retail park, however it would be of a relatively simple appearance and comparatively low level in its mass. As such the building would not appear overly dominant or incongruous in this location, · A suitably worded condition could be imposed to secure an appropriate landscaping scheme that, along with the existing trees and vegetation to be retained, could soften the impact of and break up sightlines into the development. · There was unlikely to be any significant impact on residential amenity by way of noise nuisance, light pollution or cooking odour due to the distance between the nearest residential properties and the proposed development. Suitably worded conditions could be imposed to require the implementation of a measures · Having regard to the above considerations, the proposed development would not harm the living conditions of nearby occupiers and was therefore in accordance with LDP Policy DM1. · The Highway Officer had recommend that a proposed controlled crossing point was implemented prior to first use of the development. · The Transport Assessment had taken a reasonable approach to future traffic forecasts and accounts for committed development in the area. The traffic generation estimates for the restaurant itself had been based on analysis of other comparable restaurants and are considered acceptable. · The Transport Assessment demonstrates that the proposed development would result in a small change in the level of queues in the area and would have only a minimal impact on the highway network. · The subsequent planning appeal was dismissed, however this was because of the potential impact on the River Dee and Bala Lake SAC. · The appeal decision was made before the Five Fords Wastewater Treatment Works benefitted from an up to date Environmental Permit. · This Environmental Permit is now held by Five Fords Wastewater Treatment Works · In respect of all other matters, the Inspector concluded that the proposed development was accordance the relevant planning policies Concerns had been received from the Community Council and from some local residents in relation to: · Potential anti-social behaviour · Litter issues · Vermin The Head of Development Management stated that these potential concerns were not planning issues and could, if necessary, be dealt with by the Public Protection Team. The Local Ward Member (Councillor Marc Jones) spoke in relation to the application and informed committee that there were three changes in the area to be mindful of: 1. Development of new homes on Plas Coch Road 2. Proposed development of new homes on the Mold Road site 3. The Marks and Spencer Food Store on the retail park The local member raised concerns that each of these had or could increase traffic flow in the area. A discussion ensued and members were minded to defer the application as they require further information in respect of the traffic assessment. RESOLVED – That the application be deferred. Reason: To allow highway/traffic implications to be reassessed in view of recent developments / permissions
