(Member’s declarations of interests in relation to this item are set out in Minute 73 above) The Chair welcomed Mr Jack Coeshott to the Meeting, who spoke in favour the application. The Officer presented the report and the following points were raised during the debate: · Acknowledgement that whilst the applicant had raised a number of points within his presentation, many of those were not material considerations that Members needed to take account of when reaching their decision. · Confirmation that the site was within settlement limits, so development was therefore considered acceptable. · Members noted the possibility of customers arriving at 9.59pm, which could result in service continuing beyond 10pm. It was therefore requested that the condition be worded to make clear that no customers would be permitted on the premises after the authorised operating hours. · Confirmation that the parking requirements for both the existing permitted use and the proposed use would be the same, and therefore the proposal was unlikely to generate any additional parking demand. · Members were advised that an approved floor plan hadn’t been submitted as part of the application. It was therefore confirmed that an approved floor plan layout would be requested as a condition. · It had been suggested that a temporary permission be granted, however, as an investment in cooking and extraction equipment would be required, it was felt unreasonable to expect the applicant to incur the cost if the permission was only temporary. · It was acknowledged that although the premises was close to a school, primary age children were unlikely to travel unsupervised and therefore unlikely to purchase hot food. The proposed hours fell outside the school day, further reducing any risk of unsupervised purchases. RESOLVED – That permission be granted in accordance with the Officer’s recommendation, subject to the following revised schedule of conditions, including an additional condition referring to approved plans and documents and an amendment to the opening hours condition to require that no customers be permitted on the premises outside of the permitted opening times: Conditions 1. (Member’s declarations of interests in relation to this item are set out in Minute 73 above) The Officer presented the report, and in doing so, displayed plans of the site to assist with his presentation. Members noted that there were no objections from any of the statutory consultees, but two public concerns had been raised with regards to the installation of kissing gates which were needed to manage safe crossings for vehicles and livestock, and to ensure that cyclists and pedestrians, especially children, approach Hafod Road safely. However, it was noted that revised plans had been submitted to replace the kissing gates with air lock gates which would still maintain field access while improving safety and controlled access to the highway. The local Member addressed the Committee, highlighting the importance of progressing the bridge construction, which would enable the permanent closure of the footpath level crossing on the Wrexham to Shrewsbury line. He asked whether a condition could be imposed to require the bridge’s completion within a set timeframe, given the history of fatalities along that section of the railway. Officers advised that conditions could not require completion by a specific date, but it would be possible to encourage earlier action by imposing a shorter period for commencement of the development. RESOLVED – That permission be granted in accordance with the Officer’s recommendation subject to the following: Condition 01 amended to limit the time for commencement to 2 years rather than 5 years The following advisory note be added to the decision: The proposed development is close to an Intermediate Gas Main.
