The Lead Lawyer referred to the Statutory Licensing Sub Committee Procedure, for information.
The Chair welcomed all attendees to the meeting and the Lead Lawyer referred to the procedure to be adopted by the Sub-Committee when considering the application. The Licensing Officer reported on the application for a New Premises Licence in respect of RRA Retail Limited, 55-57 Eversley Road, Swansea, SA2 9DE which had been received on 3 July 2026. The application proposed: Supply of Alcohol (off sales) Monday-Sunday 0600-2300 The Licensing Officer referred to the Licensing Objectives, policy considerations, and guidance from the Home Office. Specific reference was made to the application and plan at Appendix A and A1, the location plan at Appendix B. Conditions consistent with the operating schedule are set out at Appendix C and representations made by Other Persons were attached at Appendix D. There were no relevant representations from Responsible Authorities. One representation had been received from Other Persons at Appendix D. The representation related to the Prevention of Public Nuisance. The Lead Lawyer referred to the non attendance of the Other Person and confirmed that the representation was included within the agenda papers for Members consideration. The Applicant described the proposed store as primarily a convenience and community-service business, with alcohol occupying approximately 10% of the shop. He outlined measures addressing crime, age-restricted sales, public safety, and nuisance. The Applicant stated that he had nearly 25 years of retail experience and operated a petrol station and convenience store in Swansea. The premises had previously operated as a bakery and was being converted into a convenience store. It was noted that alcohol would not be the primary business, with the approximately 1,300-square-foot shop mainly selling snacks, soft drinks, cakes and other convenience goods. The Applicant reported that the premises would have continuously recording 24-hour CCTV and that trained staff would remain at the till. Staff would be trained under a Challenge 25 policy for checking customers’ ages when selling alcohol and other age-restricted products. The Applicant referred to staff training records which would be maintained and refusals of alcohol or other age-restricted products would be recorded in a refusals book. The Applicant acknowledged that the premises was on a busy road and stated that staff would monitor the area outside the shop. Public bins would be provided on both sides of the premises and the surrounding area would be kept tidy. In response to Member questions, the Applicant stated that: • Opening Hours – the shop would open at 6:00 however alcohol would be only be part of the broader convenient store operation rather than its predominet purpose. • Late Closing – whilst 23:00 was the permitted closing time the shop could close earlier if there was insufficient customer demand. • Character of the Area – the premises would function as an ordinary convenience store that also sold alcohol and would not negatively impact the ambience of the area. • Additional Community Services – the store was intended to provide several local services beyond alcohol sales including Paypoint, parcel handling, newspapers, magazines, coffee and potentially the National Lottery. It was Resolved that the press and public be excluded from the hearing in accordance with paragraph 14 of the Licensing Act (Hearings) Regulations 2005, to enable the Sub-Committee to take legal advice. (Closed Session) Members discussed the issues relating to the application. (Open Session) The Lawyer advising the Sub-Committee gave a comprehensive overview of the legal advice tendered. The Chair indicated that the Sub-Committee had considered the application and representation made and the needs and interests of all parties in terms of the Council’s Statements of Licensing Policy, statutory guidance and the requirements of the Licensing Act 2003. Reasons for Decision The Sub‑Committee carefully considered the application and operating schedule, the Officer’s report and agenda pack, the written representations from other persons, the oral submissions made on behalf of the applicant, the Council’s Statement of Licensing Policy, and the Statutory Guidance issued under section 182 of the Licensing Act 2003. The Sub‑Committee determined the application on its individual merits with a view to promoting the four licensing objectives. The Sub‑Committee attached significant weight to the fact that no relevant representations were received from any Responsible Authority, including South Wales Police, licensing, Environmental Health and Trading Standards. Members considered this to be a strong indication that the application did not give rise to concerns of a regulatory nature in respect of the licensing objectives. The Sub‑Committee carefully considered the written epresentation from the Other Person. The Sub‑Committee recognised these concerns as genuinely held. However, Members noted that certain matters raised were not licensable matters or are beyond the control of the premises licence holder and therefore cannot be determinative of the application. These matters were nevertheless considered insofar as they related to the licensing objectives. The Sub‑Committee therefore resolved to grant the application. Right of Appeal Any party to the decision has the right to appeal to the Magistrates’ Court within 21 days of receipt of the formal decision notice.
