Premises – The Stag Inn, Llanidloes Applicant – Tanya Burne Interested parties – Mike Andrews The Licensing Officer presented the licensing authority’s position as outlined in the report [copy filed with the signed minutes]. The Licensing Officer highlighted that after discussions with the Dyfed Powys Police Licensing Officer and Powys County Council’s Environmental Protection Team regarding the licensing conditions and times of licensable activities applied for Ms Burne had agreed to amend the application. As a result, there were no further representations from these Responsible Authorities. The Licensing Officer advised the Sub-Committee that on 24 November that B2 had withdrawn their objection. In response to questions from the Sub-Committee, the Licensing Officer advised that the premises closed in June 2023 and the licence had not been surrendered as a result of any request by any responsible authority. He confirmed that applicant was not associated with the past licence holder. The Sub-Committee noted that three of the four licensed premises in the town centre had licences allowing them to operate to 1am. The Licensing Officer confirmed that the revised application was for live and recorded music to be played indoors only. Ms Burne advised that considered that most of the concerns were about the use of the garden. As they do not currently have a kitchen the flexibility with operating times would help them, but it is not their intention to have loud music every Friday and Saturday. She also felt that it was only fair to have operating times as the other premises in the town. She advised that two members of staff are experienced in the hospitality trade and one of these lives above the premises. In response to a question Ms Burne advised that the upstairs area was not included in the licence. In response to a question regarding music she advised that the hours applied for would give them flexibility but they would not have bands or music every night. She acknowledged that as this is an old building it is not good at containing sound. She was therefore looking at whether she could have a building at the back to contain the sound. In respect of people leaving the premises late at night she would ask them to be respectful of neighbours. Mr Andrews explained that he lived door and was concerned about the noise on the street when people were smoking outside and leaving especially at 1am. He also wondered whether they would use the shared passageway to the back of the building. He wondered whether a sound limiter could be used to automatically reduce sound levels if they became too high. Ms Burne acknowledged the concerns raised by Mr Andrews. She advised that the shared passageway would not be used to enter or exit the garden. She indicated she would ask people to leave quietly. In response to a question from the Solicitor the Licensing Officer advised that the beer garden was not included in the licensable area for he premises licence in the revised application. All parties confirmed that they were satisfied that they had been able to make their representations. The Sub-Committee withdrew to consider, in private, the application and the evidence they had heard, with the support of the Clerk. On their return the Chair announced their decision. In reaching the decision members took into account the relevant written and verbal representations.
