RESOLVED to note the minor amendments made to Sections 1, 2 and 3 of the Constitution by the Head of Legal Services and Monitoring Officer as set out in part 2 of the report. RECOMMENDED to Council to approve the amendments to Sections 3 and 7 of the Constitution as set out in part 3 of the report incorporating the points made by the Committee about publication of agendas applying to all Committees and the amendment to Section 7.7.
The Committee noted minor amendments made by the Head of Legal and Monitoring Officer to Sections 1, 2 and 3 of the Constitution. The Committee considered amendments to Sections 3 and 7 of the Constitution requiring Council approval. The Committee suggested that the Constitution should be amended to include a definition of “job share”. [Following the meeting the Head of Legal and Monitoring Officer emailed members of the Committee and got their approval for the inclusion of the following definition within Rule 2.2.2 of Constitution: “job-share” means “an arrangement where two or more individuals share the duties and responsibilities of a single full-time executive or non-executive role with the remuneration and time commitment being split. The responsibilities are shared but each person may take on specific aspects of the role.”] The main change proposed was the proposal to extend agenda publication from 3 to 5 clear days which had been requested by the Chairs of the Scrutiny Committees. The Committee agreed that this should apply to all council meetings. It was agreed that references to “pre-scrutinise” in Section 7.7 should be replaced with “pre-scrutinise Cabinet reports”. The other main change proposed was that Cabinet must have a written response to scrutiny recommendations before making decisions. The Head of Legal and Monitoring Officer agreed to consider a protocol for notifying members of changes to recommendations made by the Cabinet although he noted that all members received Cabinet minutes for information. The Committee was advised that County Councillor Gareth E Jones had written with regard to gender references in the Constitution and whether it would be more appropriate to refer to “he, she or they”. The Head of Legal and Monitoring Officer advised that it would take time to work through the Constitution and make that change and that Section 2.3.4 gave provision for that “2.3.4 Unless the context requires otherwise, the singular shall include the plural and vice versa, and words expressed in any gender shall include any other gender.” RESOLVED to note the minor amendments made to Sections 1, 2 and 3 of the Constitution by the Head of Legal Services and Monitoring Officer as set out in part 2 of the report. RECOMMENDED to Council to approve the amendments to Sections 3 and 7 of the Constitution as set out in part 3 of the report incorporating the points made by the Committee about publication of agendas applying to all Committees and the amendment to Section 7.7.
