Response by the Cabinet Member: A new contract for HWRC’s was awarded and the tender included provision for a booking system and charges for some types of DIY waste. This proposal was included in the Budget agreed by full council in February 2024. The new fees and charges were not published in the register of fees and charges, although PCC set the fees and have since published them on the website. The providers retain this income and would have factored this income stream into their bids and tendered their price on that basis. The contracts have been awarded on this basis, to make any change to the contract now could mean cessation and/or termination of the contract and that could leave the Council open to legal challenge, which could potentially lead to additional cost as well as an increase in the contract cost itself. Introduction of new charges does not require a formal approval process. The Council operates on the principal that any new fees, or fees having a larger than average % increase, that generates an increase to income budgets, will need budget virement and an appropriate approval process. There is no additional income or budgetary benefit from these fees and a virement will not be required. The original proposal for the HWRC changes was identified through 2024-25 budget setting regime and an impact assessment was completed (see attached) - this proposal would have been fully debated at budget setting meetings, scrutiny and full council and approved as part of the overall budget: Cost Reduction HTR “ Review of HWRC contract to introduce charges for DIY waste disposal, implement a booking system and profit share agreement. Possible implementation date 1st July 2024 in line with HWRC contract tender. “ The Fees and Charges register is regularly updated to reflect any changes.
