The Committee noted that the Head of Legal and Monitoring Officer had been tasked to undertake a complete review of the Council’s Constitution by the end of the year. This first tranche was a review of Sections 4 and 11, which included both major and minor changes and also formalised current practice. He apologised that the original reports pack did not show the tracked changes, but this had been circulated earlier in the day. The Head of Legal and Monitoring Officer referred to paragraph 2 of his report and each change detailed in his report. The Committee considered each of the changes indicated in the report. In addition, the Committee also discussed the following: Section 4 4.6.2 – replace the comma after Framework with “and”. The sentence should read “approving or adopting the Corporate Strategic and Equity Plan (CSEP), Policy Framework and the Budget; 4.10 – comment was made that it was not equitable to appoint the Chair, Vice Chair and Assistant Chair on a Montgomeryshire, Radnorshire and Brecknockshire rotation as Radnorshire with the smallest number of councillors had more opportunities to make such nominations. Further comment was made that the Shires had not existed for many years and reference to the Shire based rotation should be removed. It was moved and duly seconded to recommend to Full Council that 4.10 is amended to remove the reference to shire-based rotation and that “the post of Chair, Vice Chair and Assistant Vice Chair will be nominated by Councillors.” Recommendation to Full Council that 4.10 is amended to remove the reference to shire-based rotation and that “the post of Chair, Vice Chair and Assistant Vice Chair will be nominated by Councillors.” 4.15.21 and 4.29A.4 – Recommendation to Full Council that Brecon Beacons National Park Authority should be replaced with Bannau Brycheiniog National Park. 4.23.2 – Recommendation to Full Council that Add in that bilingual agendas should also be published. 4.28 to 4.36 – for clarification a distinction between councillors [members] and members [lay or co-opted members] should be made to avoid misinterpretation. It was moved and duly seconded that the Constitution should differentiate between councillors and lay members and that lay members cannot ask questions to Full Council. Recommendation to Full Council that the Constitution should differentiate between councillors and lay members and that lay members cannot ask questions to Full Council. 4.97 - 4.98 - the Committee noted that the published Petition scheme states that a petitioner has 3 minutes to present their petition and that it is proposed that the Constitution is changed to reflect this. Comment was made that it was considered that 5 minutes rather than 3 was more appropriate. It was moved and duly seconded that a petitioner has 5 minutes to present their petition and that the Petition scheme is changed to reflect this. Recommendation to Full Council that a petitioner has 5 minutes to present their petition and that the Petition scheme is changed to reflect this. 4.39 – in respect of rejecting motions, the Head of Legal and Monitoring Officer advised that the Chair would be given advice regarding motions and it was for the Chair to consider this but had discretion to reject motions. He advised that the Chair could ignore the advice but had to follow the Constitution. Recommendation to Full Council that 4.39 should read “The Chair upon receiving advice from the Monitoring Officer may reject motions if…” Section 11 Concerns were raised regarding the consistency in the budgetary responsibilities across officer roles. In response the Head of Legal and Monitoring Officer advised that the information in Section 11 regarding officers had been taken from the respective job descriptions. The issue of budgetary responsibilities would be clarified and any changes to the job descriptions would then be reflected in the constitution. 11.6 - in response to question the Head of Legal and Monitoring Officer advised he would clarify whether the Chief Officer Finance in addition to being a qualified accountant would also need to be a paid-up member of a professional body. If changes were made to the job description changes would need to be made to the Constitution. It was moved and duly seconded that the proposed amendments to Sections 4 and 11 of the Constitution as set out in Appendix 1 of the report be approved with the additional amendments as detailed above. Recommendation to Full Council Reason for Recommendation: That the proposed amendments to Sections 4 and 11 of the Constitution as set out in Appendix 1 of the report be approved, with the additional amendments as detailed above. The Committee considered the report in respect of minor amendments to the Constitution. It was moved and duly seconded to note the minor amendments made to the constitution by the Head of Legal and Monitoring Officer. Resolved Reason for Decision That to note the minor amendments made to the Constitution by the Head of Legal Services and Monitoring Officer. To monitor, review and make minor amendments to the Constitution in accordance with Rules 2.4, 2.7 and 2,8 of the Constitution.
The Committee considered the report regarding the review of the Petition Scheme. The Committee considered the following issues: i. Petitions regarding local issues: the definition of “local” was considered and whether this should be village, town or ward specific or within a certain radius. Comment was made however, that a “local” issue could still have ramifications for other parts of the county of the county as a whole. It was considered that whether a petition, with over 500 signatures, was considered to be a “local” issue should be considered by the Chair of Council upon receipt of advice from the Monitoring Officer. If a petition is deemed to be so, it will be referred to the relevant Portfolio Holder and Head of Service to respond to and the local councillor will be advised of this. If the petitioner is dissatisfied with the response from the Portfolio Holder and Head of Service, they could ask that the matter may be escalated to Full Council. ii. A petition should be refused if the issue, to which it refers, has been debated by Council in the last six months: it was considered appropriate that if the subject of a petition was the same as an issue debated in Council in the previous six months it would be rejected. iii. No visual presentations should be made at a Council meeting when a petition is debated: to align the Petition Scheme with the Planning Protocol a petitioner would not be allowed to make a presentation at a Council meeting where a petition is debated. It was moved and duly seconded to recommend changes to the Petition Scheme. Recommendation to Council: Reason for Recommendation: i. Petitions regarding local issues: the Chair of Council upon receipt of advice from the Monitoring Officer will consider whether a petition with over 500 signatures relates to a “local” issue. If a petition is deemed to be so, it will be referred to the relevant Portfolio Holder and Head of Service to respond to and the local councillor will be advised of this. If the petitioner is dissatisfied with the response from the Portfolio Holder and Head of Service, they could ask that the matter may be escalated to Full Council. ii. if the subject of a petition was the same as an issue debated in Council in the previous six months it would be rejected. iii. a petitioner would not be allowed to make a presentation at a Council meeting where a petition is debated. To comply with our obligation to review the petition scheme from time to time. The Head of Legal and Monitoring Officer advised that further meetings of the Committee would be added to dairies to enable it to consider further amendments of the Constitution. In response to a question the Head of Legal and Monitoring Officer he apologised for the need to change the date of this meeting due to a diary clash in his diary.
