Grid Ref: E: 321301 N: 322385 Valid Date: 01/07/24 Community Council: Llansantffraid Community Council Applicant: Callum Hughes Location: Plasgwyn Bungalow, Llansantffraid-Ym-Mechain, SY22 6TR Proposal: Change of use of 2 sheds and yard from agricultural to agricultural machinery business (storage, maintenance and repairs), parking areas, stopping up of one access and alterations and improvements to main access Application Type: Full application The Senior Planning Officer advised that the recommendation was for approval subject to the conditions contained in the update report. Councillor G Thomas spoke as the local representative. Councillor Bethan Cross spoke on behalf of Llansantffraid and Deytheur Community Council. Richard Corbett spoke as the agent and Callum Hughes spoke as the applicant. The Senior Planning Officer confirmed that the poultry unit to the south of the site was not in the ownership of the applicant. In response to a question regarding the call-in, the Development Management Team Leader advised that the local member had not called in the application within the required timescale and as no consultees had objected to the application Development Management considered that the application could be considered under delegated powers. The Senior Planning Officer advised that if the Committee was minded to approve the application the condition regarding landscaping could be amended to require screening around the buildings. In response to questions the Highways Authority advised that the application was a challenging one from a highways perspective, due to the class of road and a number of pinch points. The traffic assessment however, suggested that the movement of HGVs would reduce compared to the current use of the site as a livestock unit. As a result, with the recommended conditions in respect of the creation of a passing place near the access point and controls on the business Highways supported the application. In response to questions the Senior Planning Officer advised that when the application was received the description of the development was for maintenance and repair of agricultural machinery and not for the sale and hire of such equipment. The Committee could only consider the application as applied for and could not add in sales or hire. In response to concerns raised about the viability of the business if the sale of machinery was prohibited by condition the Development Management Team Leader understood these concerns but advised that it was not in the gift of the Committee to change the description of the application. A further application would need to be made if the applicant wanted to develop the business in this way. It was moved and duly seconded to approve the application as recommended in the update report with an amended condition requiring the landscaping around the buildings. The Senior Planning Officer advised that the conditions regarding landscaping would read as follows: · Prior to first operational use of the site a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority to include planting on the north and northeast sides of the buildings. The scheme shall include indications of all existing trees (including spread and species) and hedgerows on the land, identify those to be retained and set out measures for their protection throughout the course of development. · That planting to be carried out within a period of 5 years from the completion of the development. The proposer and seconder confirmed they were happy with these proposed conditions. RESOLVED: Reason for decision: that the application be granted consent, subject to the conditions set out in the update report which is filed with the signed minutes and the following amended and additional conditions regarding landscaping: • Prior to first operational use of the site a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority to include planting on the north and northeast sides of the buildings.
