Response by the Cabinet Member: Thank you for your questions about planning enforcement which is an essential function of the Council’s Planning Service. Planning enforcement was identified by the recent Audit Wales Review of the Planning Service, May 2023 as an area for improvement. In response to the Review, a Planning Service Improvement Board has been established to provide corporate oversight and political and strategic direction. The Board has developed an Improvement Action Plan and actions relating to planning enforcement include: a review of planning enforcement policies and procedures such as investigating the potential to introduce a post determination/pre-implementation service to advise applicants on discharge of condition requirements; and a review of the Service’s structure which has led to the establishment of two Enforcement Planner positions. In response to your second question, alleged planning enforcement breaches including breaches of planning conditions can be reported to the Council via the on-line reporting system for investigation. In line with the Council’s enforcement policy, when investigating an alleged breach officers must gather robust evidence to determine whether further action is necessary (expedient). Evidence can be gathered using various methods such as a site visit by an Officer or by serving a Planning Contravention Notice which requires information to be provided to the Authority. Further information about these can be found here: Planning Enforcement - Powys County Council With regard to the specific example of obstructing a highway, this is not a matter for the Local Planning Authority; such matters should be reported to the relevant authority.
