Premises – Aberclydach House, Tal-y-bont Applicant – Nepali Village Interested Parties – Tal-y-bont Community Council represented by Councillor Simon McLellan and Glyn Thomas. The Licensing Officer presented the licensing authorities position as outlined in the report (copy filed with the signed minutes). The Licensing Officer explained that the application had been amended, and the revised application had been circulated to and considered by the Sub-Committee prior to the hearing. The amendments removed live music, recorded music and performances of dance from the licensable activities and included revised internal and external plans. It was noted that the application now related solely to the sale of alcohol during the hours specified in the report pack. The Licensing Consultant reiterated the amendments that had been made to the application and advised that the revised operating schedule and proposed conditions were sufficient to promote the licensing objectives and address the concerns raised by the Community Council. Councillor Simon McLellan addressed the Sub-Committee on behalf of Talybont-on-Usk Community Council. He explained that the Community Council’s objections were primarily focused on the potential for public nuisance arising from the sale and consumption of alcohol. It was requested that appropriate conditions be imposed on the premises licence to protect local residents and visitors from noise, light pollution and other forms of disturbance. Clarification was sought by members on the current and historical use of the premise, the Licensing Officer referred to a representation submitted by the Brecon Beacons National Park Authority concerning the existing planning permission for the site. The Licensing Officer explained that, in light of the planning issues raised, the Applicant had requested that any grant of the premises licence should not take effect until 1 December 2026, thereby allowing time for the relevant planning matters to be resolved. It was noted that matters relating to Dark Skies status and highway safety fell within the remit of the Brecon Beacons National Park Authority and other relevant statutory bodies, rather than the Licensing Sub-Committee, whose consideration was limited to the licensing objectives under the Licensing Act 2003. The Sub-Committee withdrew to consider, in private, the application and the evidence they had heard, with the support of the Clerk. On their return the Chair announced their decision. In reaching the decision members took into account the relevant written and verbal representations.
