RESOLVED That the application be suspended for a period of six months.
Having convened in private session under the terms of Section 100A(4) of the Local Government Act 1972, the Sub-Committee considered the report of the Lead Licensing Officer regarding the Vehicle Drivers Licence Ref 01. The applicant and their representative were present online at the Hearing and were provided the opportunity to present their case to the Sub-Committee and to respond to questions from Members of the Sub-Committee. The Solicitor outlined the options for the Sub-Committee to determine the application. The Sub-Committee then retired to undertake its consideration of the representations submitted. The Sub-Committee then resumed and the Chair announced the decision. Moved by Councillor Tim Evans; Seconded by Councillor Vanessa Thomas. The vote, undertaken by way of a show of hands, was carried. DECISION That the Sub-Committee has carefully considered all representations made before it from all parties. The Sub-Committee is tasked with deciding whether the driver is a fit and proper person to be allowed to continue to hold a joint hackney carriage and private hire driver licence. The Sub-Committee in deciding this always has at the forefront of its deliberations and as its primary consideration public safety. The Sub-Committee has taken into account all matters pertaining to the matter which is before it and the representations made by the Lead Licensing Officer. The Sub-Committee has had regard to the relevant provisions of the Local Government (Miscellaneous Provisions) Act 1976 relating to suspension or revocation of Drivers licences. The sub-committee takes seriously that this is not the first time the applicant has been in front of the Sub-Committee within the last 12 months. The Sub-Committee take into account the fact that the police have dealt with the matter as constituting driving without due care and attention. The Sub-Committee is not satisfied as to the reasoning offered for the applicants actions by the applicant, and are not reassured as to the applicant’s judgement at the time of the offence. The Sub-Committee feel that it was fortunate for the fast thinking reaction of the cyclist at the time which prevented a more serious outcome. The Sub-Committee’s options include taking no action against the licence, issuing a warning, revoking the licence or suspending the licence for a period of time. The applicant has expressed remorse. The primary concern of the Sub-Committee is the issue of public safety. The driver’s action, whilst in no way condoned, does not merit full revocation of the licence permanently, and the Sub-Committee’s decision, taking into account all factors presented to it, is to suspend the licence for a period of six months, to reflect that it is considered to be a serious matter. As this decision is based on public safety grounds, the suspension is of immediate effect, irrespective RESOLVED That the application be suspended for a period of six months.
