The Chair thanked Members of the Committee for re-electing him as Chair of Planning Committee. The Chair expressed great sadness at the passing of Councillor Brian Hall noting that he had always been a great contributor of the Planning Committee and held a passion for Pembroke Dock, even when an application was centered on a different Community. The Chair noted that a suggestion had been made to move to electronic voting for Planning applications however, he then Moved that they would remain as a roll-call method of voting; Seconded by Councillor John Cole. The vote, undertaken by way of a show of hands, was carried. RESOLVED That the voting method would remain as a roll-call. The Chair then welcomed the Head of Planning to present an update to the Committee: Officers continue to progress the workstreams of the Council’s nitrates Action Plan. Work stream 1: Delivery of a strategic mitigation package Officers have met with the consultants to review the output of the commissioned work and are pleased with the mitigation opportunities identified for 5 individual land holdings reviewed. Mitigation opportunities found equate to 8.5% of the total housing land supply for LDP2. The final report is scheduled to be provided to officers by the end of this week. Officers are in the process of matching up the mitigation identified with priority developments. The next steps will be further phase(s) of the commission to look at a selection of other land holdings within the Council’s ownership to identify mitigation opportunities. Workstream 2: Developer Mitigation Handbook. The handbook has been disseminated and is being used by applicants, agents and developers. It will shortly be published to the Council’s updated nutrients webpage. Workstream 3: Officers continue to develop a workable framework for implementation of a local credit trading system using nutrient mitigation brought forward on the county farm estate with priority being given to the Council’s development needs before being offered out at a cost to other priority development. Work to pursue preparation of a Strategic Level Habitats Regulations Assessment (HRA) for existing and future housing supply following a threshold then integrated approach is ongoing. Officers have met with Natural Resources Wales (NRW) officers to align this piece of work with NRW’s nutrient catchment recovery plan. NRW with assistance from PCC officers will work to identify secure restoration measures within the catchment so that they can be taken into account when using an integrated approach to reduce the amount of mitigation that development will need to find. The Local Planning Authority continues to hold planning applications for housing where nitrates is the sole issue. Officers continue to work with planning agents/developers who propose to secure off site nitrogen mitigation for their development proposals. The number of applicants seeking to identify and secure private mitigation is increasing. The Authority has appointed a dedicated nutrient officer for a 3-year period who will lead on mitigation and implementation of a local credit trading system. A dedicated project delivery officer working within the Planning Service is focused on working with stakeholders to bring forward restoration measures within the catchment. Both these and other officers within the Planning Service continue to work with all stakeholders including the West Wales Nutrient Management Board on addressing nutrient issues within the Cleddau catchment. On a final point, I have recently communicated to Councillors an important development in the Examination process of the LDP2 which highlighted that the Authority will be participating in an Exploratory meeting called by Planning Environment Decisions Wales (PEDW) Inspectors in relation to the Council’s LDP2 where concern has been raised by the Inspectors over the impact of nitrates requirements on the deliverability of proposed sites. The meeting will take the form of a structured discussion between PEDW Inspectors and officers of the Local Planning Authority, NRW and WG. The meeting will be held at County Hall on 16th June 2026 with arrangements being made for the public to observe the meeting. The Examination page of the Council’s website will be kept up to date with relevant information in relation to this meeting and the Examination of the LDP2 in general.

RESOLVED That the application be APPROVED subject to the conditions outlined in Section 1.1 of the report.
[Having declared a Personal and Prejudicial interest Councillor Simon Hancock left the meeting for this item of business.] The application was presented for Committee consideration as, following a Planning Delegation Panel (PDP) request, the Assistant Chief Executive has exercised discretion to remove it from the scheme of delegation following a request by the Local Member. The ground for referral relates to Criterion 2 – The Decision on a proposed Development’s Impact within the local Community is finely balanced between competing interests or is complex and sensitive and would benefit from a public examination of the merits (Appendix 1 to Section 14 of the Constitution. The Planning Officer presented the application to the Committee. The Committee was advised that due notification had been received from the following interested parties who wished to exercise their right to address the Committee: • Drew Baker (Applicant) The Applicant highlighted that the application would provide a sustainable and viable future for the Grade II listed building which had been largely unused since court functions had relocated. The Chair then invited questions from Members to the Agent. In response to a question from Councillor John Cole regarding pictures or plans of the interior of the Shire Hall, the Applicant advised that the plans had been submitted as part of the Listed Building application. The Chief Planning Officer advised that this application was for a change of use of building and confirmed that the listed building application did include the plans of the changes however, this was not part of the planning process. Councillor Tim Evans noted that he was supportive of the application however, he was aware of concerns raised by the local Civic Society regarding the furnishings within the Court building. The Applicant reassured the Committee that, following conversations with CADW, all furnishings would be placed in appropriate storage with some remaining in place. In response to a further concern raised by Councillor Tim Evans regarding the building in its entirety, the Applicant advised that the application was for a change of use for the courtroom but that there would also be a café at the front of the building and a pizza restaurant above. Councillor Steve Alderman raised concerns on the number of theatres that were already in place in the County and the effect this application could potentially have on those. The Applicant advised that they already held the Boulevard Theatre in Milford Haven which was in very close proximity to the Torch Theatre which had both survived. It was further noted that they would be moving from the Boulevard Theatre to the Shire Hall if approved. In response to a question raised by Councillor Alan Dennison regarding the seating at the Shire Hall, the Applicant advised that they anticipate this to be approximately 300 seats. The Applicant also clarified that the parking outside of the building was public parking. The Chair clarified that he had spoken with the Local Member, Councillor Tom Tudor who had advised of his support of the application. The Head of Planning reminded the Committee that this application was solely concerned with the land use and not about protecting other businesses. There were no further questions raised to the Agent and the Committee proceeded to debate the Application. In response to a question raised by Councillor Alec Cormack regarding the red lines shown on the application plan, the Chief Planning Officer advised that the line was around the ground floor court room only. The upper floors had already been through the change of use process. In response to concerns raised by Councillor Alan Dennison regarding capacity of the court room, the Chief Planning Officer advised that they did not have the historical data on capacity however, acknowledged that footfall would likely increase as a theatre. Councillor Dennison highlighted a further concern on the increase in sewage created by the change of use however, the Chief Planning Officer advised that no concerns had been raised through the application process. Councillor Tim Evans raised concerns on the time frame involved, the Head of Planning advised that Planning Officers had already undertaken meetings and site visits with Cadw, the Owner and the Operator and that the assessment and evaluation were ongoing. Approval of the application was Moved by Councillor Tim Evans; Seconded by Councillor Alec Cormack. The vote, undertaken by way of a roll-call, was carried. The votes were recorded as follows: For the Motion: Councillors Steve Alderman, Mark Carter, Alec Cormack, Tim Evans, Nick Neumann, Iwan Ward, Michele Wiggins, Tony Wilcox, Chris Williams, Michael Williams and Danny Young [11] Against the Motion: Councillors John Cole and Alan Dennison [2] There were no abstentions. RESOLVED That the application be APPROVED subject to the conditions outlined in Section 1.1 of the report.

RESOLVED That Delegated Authority be granted to the Head of Planning to determine the application.
[Having declared a Personal and Prejudicial interest Councillor Steve Alderman left the meeting for this item of business.] The application was presented for Committee consideration as the application was withdrawn from the agenda for the 2 December Planning Committee meeting. The application was for Committee consideration as the application was for a wind turbine over 30 metres in overall height to blade tip (Appendix 1 to Section 14 of the Constitution). The Planning Officer presented the application to the Committee advising Members that the Agent had requested a deferral of the decision due to the incomplete bat survey data to be determined at the November Committee to allow a final bat survey to be undertaken in September. The Committee was advised that due notification had been received from the following interested parties who wished to exercise their right to address the Committee: • Richard Grist (Agent) The Chair then invited questions from Members to the Agent. In response to a concern raised by Councillor John Cole regarding the reasons for replacing the existing turbine, the Agent advised that the existing turbine having been in place for 12 years and that they were looking to replace this with a more efficient turbine due to its location. The Agent clarified that the existing turbine was unlikely be scrapped and would be utilised at a different location. Councillor Alan Dennison questioned the reasoning behind moving one turbine to a different location to replace the existing one and the Agent explained that they were seeking to maximise the return from any turbine location as a larger turbine captured more energy and generated more electricity. In response to a question raised by Councillor Iwan Ward regarding the money generated, the Agent advised that all energy was fed into the National Grid and the Chair highlighted that this was not a question for the Planning Committee. There were no further questions raised to the Agent and the Committee proceeded to debate the Application. The Chair raised concerns that the Officer reluctance to defer the application as due to the effect on the statistics of the Planning Department. The Head of Planning clarified that they were seeking to bring the application to a conclusion as it had been in place since May 2025 and it was best practice that any survey work be undertaken prior to the submission of an application. The recommendation for refusal is due to the amount of work still required. The Head of Planning further clarified that the deferral can be considered by the Committee but that this must be balanced with the impact of performance of local planning Authority’s and that a resubmission could be undertaken on completion of the work. Councillor Simon Hancock then Moved that the Application be Refused which was not Seconded at this juncture. Councillor Alec Cormack highlighted that deferral to December would allow adequate time for the final bat survey to be undertaken. The Chief Planning Officer advised that further dialogue had been undertaken since the agenda was published together with confirmation having been received noting the administrative burden of resubmission. However, dialogue with the Applicant had confirmed that they had agreed to an extension of time until November 2026 which would reduce the burden. In response to a suggestion from Councillor Alan Dennison that the application could be Approved subject to the results of the final bat survey however, the Head of Planning advised that this was the impact of a protected species in an area of significance which could not be Approved subject to the results. The requirement for mitigation could not be known at this point in time and would therefore not be appropriate. Councillor John Cole then Moved that the application be deferred to November 2026; Seconded by Councillor Tim Evans. The Head of Planning then suggested a further option which would grant delegated Authority to the Head of Planning to determine the application subject to the outcome of the bat surveys. Councillor John Cole then withdrew his proposal to defer the application to November 2026 and Moved that delegated Authority be given to the Head of Planning to determine the application subject to the outcome of the bat surveys; Seconded by Councillor Tim Evans. Councillor Simon Hancock then emphasised his disappointment that Members of the Committee were recommending togo against the recommendation from Officers. The Committee then debated the new proposal. In response to a concern raised by Councillor Tony Wilcox regarding the extra height of the turbine, the Head of Planning advised that an assessment of the further survey work would be undertaken which could result in the impact of the protected species as being unacceptable and it could then be refused. Councillor Michael Williams concurred with the concerns raised by Councillor Simon Hancock that they were now voting to go against Officer recommendations and noted that he had wanted to second the Motion made by Councillor Hancock. The Solicitor clarified that the Motion put forward by Councillor Hancock had fallen and that the Committee now had a substantive Motion in place. In response to further concerns on the technology raised by Councillor Michael Williams, the Democratic Services and Scrutiny Officer explained that there had been no sight of a hand raised by Councillor Michael Williams and that the Chair had requested a Seconder for the Motion a number of times. The Chair further clarified that Councillor Hancock had withdrawn his proposal. The Head of Planning explained that they have to bring applications to a conclusion and that, at the time of the report writing, there was not sufficient information received as to when the surveys would be undertaken. This situation had evolved which had necessitated the explanation of the change. The Chair then clarified that Councillor John Cole had Moved that Delegated Authority be granted to the Head of Planning to determine the application; which had been Seconded by Councillor Tim Evans. The vote, undertaken by way of a roll-call, was carried. The votes were recorded as follows: For the Motion: Councillors Mark Carter, John Cole, Alec Cormack, John Davies, Alan Dennison, Tim Evans, Nick Neumann, Iwan Ward, Michele Wiggins and Danny Young [10] Against the Motion: Councillors Simon Hancock, Tony Wilcox, Chris Williams and Michael Williams [4] There were no abstentions.
