RESOLVED That the application submitted by TR be approved.
Having convened in private session under the terms of Section 100A(4) of the Local Government Act 1972, the Sub-Committee considered the report of the Lead Licensing Officer regarding the application for a combined Hackney Carriage/Private Hire Vehicle driver’s licence by TR. The applicant was present at the Hearing and was provided the opportunity to present their case in full to the Sub-Committee, which included answering questions from the Members. The Solicitor outlined the options available for the Sub-Committee Members to decide on the application. The Sub-Committee then retired to undertake its consideration of the representations submitted. The Sub-Committee then resumed, and the Chair announced the decision. DECISION The Sub-Committee has taken into account the representations by and on behalf of the applicant. It is recognised by the applicant that the incident was a stupid mistake that will not be repeated. The Sub-Committee is satisfied that the applicant is genuinely remorseful, and also that this was a one-off incident, the applicant being otherwise of completely good character. The Sub-Committee considers that the applicant is fully aware of the impact on the applicant’s driving licence if there is a repeat. The Sub-Committee also notes to the applicant’s credit that full disclosure of the incident was supplied in the application. Although it would be in line with the Sub-Committee’s policies not to grant the application, for the above reasons the Sub-Committee is content that it can depart from its policies, being satisfied that the applicant is a fit and proper person to be granted a combined licence, there being no concerns about public safety. This view is endorsed by the lack of formal representations from the Police. The application is therefore granted. The vote, undertaken by way of a show of hands, was carried. RESOLVED That the application submitted by TR be approved.
Rhaid i gynghorwyr ddweud pan fydd ganddyn nhw gysylltiad personol â rhywbeth sy'n cael ei drafod, fel swydd, eiddo neu aelod o'r teulu. Mae buddiant sy'n rhagfarnu yn ddigon cryf i'r cynghorydd adael yr ystafell fel arfer a pheidio â chymryd rhan.
Caiff datganiadau eu darllen o'r cofnodion unwaith y byddan nhw wedi'u cyhoeddi.
