RESOLVED That it be recommended to Council that the Notice of Motion be not adopted.
The Committee considered a report by the Head of Law and Governance regarding a Notice of Motion (NOM) relating to Cabinet Members not being employed by a Member of Parliament or Senedd Member, which was submitted by Councillor Jamie Adams and referred to the Committee by Council on 6 March 2025. The Head of Law and Governance introduced the report and highlighted that the role of the Presiding Member was introduced in 2018 to enable to Chair of the Council to carry out their required civic duties. It was the Committee’s decision as to whether the NOM should be adopted. Regarding the NOM, Councillor Pat Davies recalled that this issue had been raised for two years, and she had experience being a Presiding Member and Chair of Council. She noted that a lot of time was taken up with both roles and historically, there had been Chairs of Council who struggled to manage Full Council meetings. A Motion was Moved by Councillor Pat Davies to the effect: That the Notice of Motion be not adopted. Seconded by Councillor Mike Stoddart. In concurring with Councillor Davies, Councillor Mike Stoddart highlighted that the only issue with the current system was that the current Presiding Member was ‘too good at their job’. Councillor Michelle Bateman agreed with the points raised and noted that the two different job roles had two very different skill sets. Chair of Council’s may not want to manage Full Council meetings or Presiding Members may not be able to undertake civic duties. As the current Chair of Council, Councillor Steve Alderman stated that he had been very busy carrying out civic duties this year and he was not sure if he would be able to chair Full Council meetings. If the NOM was adopted, he suggested that this should be introduced for the incoming Chair of Council. Councillor Huw Murphy suggested that the NOM be adopted but it is not implemented for 12 months in order for the incoming Vice-Chair of Council to prepare for both roles as the Chair of Council and Presiding Member. It was confirmed that the proposal would not be acceptable as an amendment as it would negate the proposed motion. The vote, undertaken by way of a roll call, was carried. For the Motion – Councillors Steve Alderman, Michele Bateman, Pat Davies, Mike Stoddart, Jacob Williams and Joshua Beynon [6] Against – Councillor Huw Murphy, Anji Tinley and Vanessa Thomas [3] Abstentions – Councillors David Howlett and Aled Thomas [2] RESOLVED That it be recommended to Council that the Notice of Motion be not adopted.

The Committee considered a report by the Head of Law and Governance on proposed amendments to Section 4.10 of the Constitution – Order of Business, Section 14 – Responsibility for Functions, and the Terms of Reference for the Governance and Audit Committee. Regarding the Order of Business, she noted that it was proposed that the Budget and Policy framework be moved up, so it was considered before Member’s Questions and Notice of Motions. Additionally, it was proposed that petitions were resolved early in the Council agenda. There were no fundamental changes to the Delegation of Planning Functions, but some wording was changed to provide clarity. The Head of Law and Governance concluded that the final proposed amendment was for ‘Global Internal Audit Standards’ to replace the ‘Public Sector Internal Audit Standards’ for the Terms of Reference of the Governance & Audit Committee in the Constitution.
