RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then resumed and the Chair presented the decision. DECISION The Sub-Committee has taken the representations by the Police into account, together with representations by the licence holder. The Sub-Committee has considered carefully all the representations it has heard this morning. The Sub-Committee’s overriding consideration must be that of public safety. The Sub-Committee has made formal findings based on what it has heard today: The Sub-Committee considers that the actions of the licence holder leading to the Caution are extremely serious, involving vulnerable persons. There is also the issue of the lack of proper insurance in place given that the vehicle involved was being driven by an unlicensed driver. The Sub-Committee does not accept as in any way valid the excuses provided by the licence holder for the incident. It is well within the Sub-Committee’s remit given its Policy on Convictions to revoke the licence today. The Policy states that a period of seven years should elapse before a new application should be considered. The Sub-Committee finds that the Licence Holder’s actions fall well below the standard expected and are wholly unacceptable. The Sub-Committee has taken into account the licence holder’s contrition but does consider that the licence holder may not realise the serious position the licence holder is in. The issue of unlicensed drivers is not to be addressed by adding to it. The Sub-Committee has taken into account the long service of the licence holder and that certain sanctions have already followed. The Sub-Committee has concluded that the matter can be dealt with by way of a formal warning to the licence holder. The licence holder is warned in the strongest possible terms about his behaviour and that a repetition will not be tolerated. On balance, due to the representations made by the applicant, the Sub-Committee is satisfied that the applicant is a fit and proper person to continue to hold a licence. The Sub-Committee is satisfied that the Licence Holder is fully aware that any further appearances before the Sub-Committee will take into account this matter and the distinct likelihood that action will be taken against the licence holder’s licence.

The Sub-Committee then resumed and the Chair presented the decision. DECISION The Sub-Committee has taken into account the representations of the applicant, and also the representations by the Police. It has also noted the representations made on behalf of the applicant. It is recognised by the applicant that there was a failure to give any detail of the first points on the applicant’s licence and the Sub-Committee accepts that this was an oversight for which the applicant apologises and also recognises the need to complete the renewal form properly. The issue of the second matter which is a conviction has been explained both by the applicant and the Police Licensing Officer so that the Sub-Committee is satisfied that the applicant would not have known about it. Further, it also would not have been put before the Sub-Committee had the applicant known about it, as it may have been disposed of differently. The Sub-Committee accepts that in any event the conviction, whilst technically a motoring offence, was one of an administrative nature rather than directly related to the applicant’s actual driving. Although, again technically, it would be within the Council’s Policy to take action by way of refusing the application to renew, for the above reasons, public safety being the primary consideration, the Sub-Committee is satisfied that the application can be granted, the applicant being a fit and proper person.
There were no declarations of interest made.
The Sub-Committee was unable to approve the Minutes of the meetings held on 9 July 2024 and 8 August 2024 as the Chair advised that Members of the Sub-Committee had not been in attendance at the meetings.
The vote, undertaken by way of a show of hands, was carried. RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the following items of business on the grounds that they involve the likely disclosure of exempt information under Schedule 12A to the Act.
