RESOLVED That Councillor Tim Evans be elected as Chair for the meeting
RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then resumed in open session. RESOLVED Newgale Campsite is a well-established campsite near Newgale Beach. The campsite is open to campers in tents, motorhomes, caravans and campervans. The applicant has hosted events using Temporary Event Notices for regulated entertainment and the sale of alcohol. He now seeks a premises licence to sell alcohol on and off site, between 8 am and 10 pm, Monday to Sunday, March to October. He also seeks a licence to play live and recorded music, when the number of attendees exceeds 500. Three written objection have been received from members of the public. The objectors complain of ‘unbearably loud’ music, public urination and littering, which accompanied previous events at the campsite. Nolton and Roch Community Council also object. They express concern about the impact of noise and littering on Newgale beach, which is a Blue Flag Beach. Further, the site is near a ‘very busy main road’ with no boundary or fence, which poses a hazard to campers and drivers alike. None of the objectors attended to make oral representations. The campsite has a certificate of lawfulness for the stationing of one mobile catering unit, for the sale of food and non-alcoholic drinks from 8 am to 11 pm. However, Pembrokeshire Coast National Park Authority has served a planning contravention notice on the applicant for breaching the certificate. He is alleged to operate more than one mobile catering unit and for these units to be on site outside of permitted hours. Nevertheless, the Park Authority do not object to the application. The applicant rejects the criticism of public urination. When on site, he has not observed it. Further, he confirms that the site will have extra portable lavatories when events are held. Likewise, the applicant rejects the criticism of noise nuisance and road safety issues. Neither Dyfed Powys Police, nor the Council’s Pollution Control Team, object to the application on either noise or safety grounds. The Licensing Sub-Committee carefully considered all the written and spoken representations made to it. It then considered the Council’s Statement of Licensing Policy and Statutory Guidance from the Secretary of State. In particular, it had regard to the need to strike ‘an appropriate balance between the economic needs of licensed premises and the rights of local residents… to enjoy a reasonable degree of peace and quiet at noise-sensitive times’. The Sub-Committee is satisfied that there is no noise nuisance emanating from the site and that any road safety issues arising from events can be dealt with on a case-by-case basis. The Sub-Committee welcomed the steps taken by the applicant to address the concerns about public urination. However, the Sub-Committee is concerned about the very early supply of alcohol. This could pose a risk to public safety, the prevention of crime and disorder, and the prevention of public nuisance. Moved by Councillor Tim Evans; Seconded by Councillor John Cole The vote, undertaken by way of a show of hands, was carried. DECISION The application is granted, subject to the following: · Sale of alcohol on and off site is restricted to 10 am to 10 pm and to the site shop/reception and the coffeeshop/ice cream parlour; · Subject to the installation of CCTV in the ice cream parlour and mobile caravan reception area;
