The Committee considered a report by the Director of Community Services on the Toilet Strategy 2023 in response to a call-in submitted by Councillor Huw Murphy, supported by Councillors Jamie Adams, John Davies, Elwyn Morse, Anji Tinley, Mel Phillips, Vanessa Thomas, Iwan Ward, Delme Harries, Shon Rees, Mike James, Simon Wright, Michael John, Alan Dennison, Peter Morgan, Reg Owens and Brian Hall in relation to the following decision made by Cabinet on 24 April 2023: a) That the Local Toilet Strategy 2023 be approved. b) That an update report be provided to the Policy and Pre-Decision Overview and Scrutiny Committee in November 2023. The terms of the call-in was that a full re-examination of the cost of retaining these public toilets is undertaken before a final decision is taken on the closure of some or all of the toilets as listed in "group 2" of agenda item 10 of the Cabinet meeting of February 13th, 2023, and clearly ratified at the Cabinet meeting of April 24th, 2023. The Chair welcomed Mr Carl Shutt to the meeting to give a presentation on the petition regarding the Toilet Strategy. Mr Shutt informed the Committee that the petition had gathered more than 2200 signatures from across Pembrokeshire and beyond. He advised the Committee that this County was reliant on tourism and visitors and that toilets were an essential convenience. Councillor Huw Murphy advised the Committee that the Authority’s strategy was to close public toilets subject to caveats and that this Call-In was to show the support for the toilets to be retained for a maximum of three years to allow potential transfers of some toilets to Pembrokeshire Coast National Park Authority or Town and Community Councils. He advised that the current timescales were unrealistic. Councillor Murphy informed Members that the Pembrokeshire County Council consultation had drawn 266 responses with universal opposition to the closures noting that any closure would impact parents of the young, the elderly, disabled and those with medical conditions. Councillor Huw Murphy then Moved that the Toilet Strategy be returned to Cabinet; Seconded by Councillor Di Clements The Committee then debated the contents of the presentation and the key points were highlighted as follows: · A comprehensive needs assessment had been conducted following the Local Government elections in 2022 and had since been reviewed in order to help address the challenges of provision of toilets. · Consultations were continuing with Town and Community Councils. · A mix of funding opportunities were available noting that car parking income could only be used to maintain those facilities linked to the car parks. · Pembrokeshire Coast National Park Authority would maintain 17 facilities that were linked to car parks. · The Cabinet Member with responsibility for Residents’ Services committed to provide a full update in November 2023 to the Committee. · In response to a request from Councillor Jordan Ryan for a guarantee that no toilets would be closed before the end of the financial year, the Cabinet Member advised that negotiations were continuing and that those with serious ongoing negotiations, would remain open to end March 2024 to allow Councils to update their precept for next year. · In response to a concern from Councillor Clements regarding the contact that had been undertaken with Town and Community Councils, the Cabinet Member advised that the strategy from 2019 was the same as the 2023 strategy. · The Strategic Business Manager advised Members that they had contacted Town and Community Councils in early 2023 and that there was active negotiations ongoing with a number of Councils. · In response to a question from Councillor Aled Thomas regarding the opportunity to scrutinise the strategy, the Chair advised Members that this had been debated by this Committee in March 2023 and was included in the Forward Work Programme with no further information available at this time. · The Cabinet Member reaffirmed that he had given the commitment to return with a full update in November 2023, or sooner if the information was available. However, he felt that the Call-In was premature and that it was not required for the subject to be scrutinised. · In response to a concern raised by Councillor Thomas regarding the strategy approved by Cabinet without Cabinet knowing all the facts, the Cabinet Member advised that the strategy was required by Welsh Government to provide an overall direction of travel. · Councillor Michael James raised concerns regarding the Health and Wellbeing of residents and the Wellbeing of Future Generations Act were facilities closed. Councillor James advised that the Strategic Business Manager was visiting Town and Community Councils to aid the discussions where possible. · The Strategic Business Manager advised that they had fully engaged with the Councils and all information was being made available regarding running costs, leasing costs, potential Community Asset Transfers etc. The Head of Law and Governance reminded Members that the Call-In was to either agree with the decision of Cabinet or to refer the decision back to Cabinet. The Committee was not able to make any substitutions to the decision made by Cabinet. Councillor Huw Murphy Moved that an amendment to the Motion for the moratorium to remain until 31 March 2024. Councillor Di Clements did not agree with this amendment.
