RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then resumed in open session. DECISION The Sub-Committee has a discretion to exempt specific private hire vehicles from the requirement to display external plates, and instead to allow the vehicle to carry licence plates inside the vehicle. The representations made by the Applicant have clarified that the application is for one specific vehicle, and that the vehicle is to be used predominantly for executive hire-type tours. Conditions imposed by the Council are required to be considered reasonably necessary, including the display of external plates. The Sub-Committee is not persuaded that the reasons for the application as detailed by the Applicant are sufficiently persuasive for the Sub-Committee to exercise its discretion and grant the exemption. It is considered that it is still reasonable and necessary in the circumstances as described for the requirement for the plates to be displayed externally to continue. RESOLVED That the application be refused.

The Sub-Committee then resumed in open session. DECISION The Sub-Committee has carefully considered the application as revised, following the agreement reached at the multi-agency meeting with the Applicant, and also the representations from the Applicant. From these matters, the Sub-Committee is more than satisfied that the application as varied and agreed promotes the licensing objectives. The Sub-Committee has taken from the agreement reached with the Applicant that those Responsible Authorities involved in the Multi-Agency Meeting, that the Applicant has already satisfied those Responsible Authorities that the Applicant has overcome the rebuttable presumption against the grant of new premises licences within a cumulative impact area. The Sub-Committee is mindful of the only outstanding representation from the Planning Department of the Council. This it considers has been answered to a great extent by the Applicant in her representations, with her indication of the intention to seek to vary the planning conditions. RESOLVED That the application as varied and agreed be granted. The Solicitor further clarified the following: This was subject to the reminder that there was no need for any conditions for hours of live or recorded music, which was a duplication of existing legislation and as such unnecessary. There was also no provision for any non-standard timings in the application so the Sub-Committee was unable to endorse any agreement about provision of door supervision at non-standard times, for example on public holidays. Whilst it may not be applicable in this application, the Sub-Committee would state that the Planning and Licensing regimes run completely separately and distinctly, and are based on different criteria. The grant of a Premises Licence was based entirely upon licensing objectives. It does not mean that there may not be a breach of Planning Conditions which would be subject to separate enforcement by the Planning Department. Grant of a premises licence does not mean that Planning Permission will be granted or varied, and vice versa.
There were no Declarations of Interest made.
Moved by Councillor Tim Evans; Seconded by Councillor John Davies RESOLVED That the Minutes of the meeting held on 2 November 2022 be approved as a correct record.
