This was extended to nine months on appeal to the Planning Inspectorate, however this was not complied with. RESOLVED That the application be deferred to allowMembers to conduct a SITE VISIT. The matter will return to a subsequent Committee meeting for further consideration.
This application was presented for Committee consideration as it involved a tourist, leisure or recreational development over 500 sq.m of floorspace or a site over 0.5ha in area (paragraph 1(g) of the scheme of delegation). The Planning Officer, Mark Hyde, provided an oral update stating that the publicity periods for the application expired on 8March 2023 (Departure Press Notice) and 11 March 2023 (Site Notice) respectively and that no representations were received during these publicity periods. The Committee was advised that due notification had been received from the following interested parties who wished to exercise their right to address the Committee: · Agent - Mr David Haward · Local Member - Councillor Delme Harries Following Mr Haward’s address, Councillor Mark Carter requested that he outline the main difference between the previous application and the current one, which he did. In response to clarification sought by Councillor John Cole, Mr Haward confirmed that some surrounding land was being let out for agricultural use, but it was not the application site. Councillor Tony Wilcox queried if it would have been more logical to re-instate the fishing business element before considering the lodges, to which Mr Haward advised that it was felt the provision of being able to stay on site would assist the fishery element. Councillor Alistair Cameron requested further information regarding how intrusive the development would be on the countryside with it being a significant development which would bring with it increased car use to and from the site. Mr Haward advised that although each cabin would be provided with parking for two cars, this would not always be the case as many visitors would travel in one car. In response to a question from the Chair regarding why a business plan had not been submitted as part of the application, Mr Haward advised that the applicant did not feel it necessary to include one. Councillor Mark Carter queried if the lodges would be removed if the fishery was not successful, to which Mr Haward confirmed that they would not be removed as the lodges and fishing element were not intrinsically linked. Councillor Delme Harries, Local Member, addressed the Committee to express his support for the application highlighting that the North of the County needed growth and investment and felt that such applications should be supported as they bring with them opportunities and employment. A plea was made for the Committee and Planning Officers to consider proactively working with the applicant to overcome any barriers which would lead to the application being refused. Councillor Alistair Cameron highlighted the importance of preserving the countryside and queried whether the Local Member had any concerns regarding the effects the development would have on that. Councillor Delme Harries stated that there would always be the need for concern due to the responsibility held to ensure agriculture is sustained, but advised that he did not have concerns with this application as its location was on the immediate outskirts of the town centre which was already scattered with properties, and was not as remote as Members may think without visiting the site. In response to a question from Councillor Tim Evans, the Local Member confirmed that the Community Council were in support of the application, despite not submitting a formal response due to timing alignments. It was noted that the only concern raised by them during a Community Council meeting was regarding an access site to the farm, which did not form part of the application being considered. The Committee proceeded to discuss the application and the key points were noted as follows: · Councillor Jamie Adams reiterated the importance of the Council working proactively with all involved in such applications to address concerns and agree on sustainable solutions where possible to encourage investment within the County, specifically within countryside areas. The Planning Officer outlined the reasoning behind the recommendation of refusal, which included failure to meet both local and National policies and legislation and the inability to use ‘farm diversification’ reasoning as the farm and fishery had both ceased trading many years ago. · Councillors Nicola Gwynn, Tim Evans and Jordan Ryan expressed their support for the application, stating that they felt such development would be successful and a benefit to the area. The Head of Planning provided advice should the Committee wish to propose the application be approved, contrary to policy, which would require invoking a cooling off period, therefore a minded-to decision would be required. · The Solicitor confirmed that it would be acceptable for the Committee to undertake a site visit, if they deemed it necessary, due to the site being difficult to assess from the plans and supporting material. Councillor Brian Hall Moved that the application be deferred to allowMembers to conduct a site visit; Seconded by Councillor Jamie Adams. The Committee proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Alistair Cameron, Aaron Carey, Mark Carter, John Cole, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Michelle Wiggins, Iwan Ward, Tony Wilcox and Jacob Williams. [14] Against the Motion: Councillor Michael Williams. [1] There were no abstentions. RESOLVED That the application be deferred to allowMembers to conduct a SITE VISIT. The matter will return to a subsequent Committee meeting for further consideration.

This application was for Committee consideration as it involved a tourist development over 500 square metres floor area (paragraph 1(g) of the scheme of delegation). The Planning Officer, Rachel Elliott, provided an oral update stating that an amended plan had been received showing the retention of two trees initially proposed to be felled. Whilst this was referred to within the report, the recommended approved plans condition should refer to the approved and amended plans, as such the recommendation should be updated. The Committee was advised that due notification had been received from the following interested party who wished to exercise his right to address the Committee: · Agent – Mr Oliver Cooper Following Mr Cooper’s address Councillor Mark Carter queried where the public house was that was referred to within the Committee report. Mr Cooper advised that the permitted and licensed public house was on the holiday park, although it had been closed for some time due to lack of demand. It was stated that it had previously been used by the wider community and not just those staying on site and was not linked to the application being discussed, but approval of the application could bring with it increased demand for the pub to re-open. In response to a point raised by Councillor Jamie Adams, the Chief Planning Officer drew Members attention to the blue line shown on the map contained within the Officers presentation, and confirmed that the application lay close to the settlement boundary. Councillor Brian Hall Moved that the application be approved as per the updated recommendation outlined within the oral update; Seconded by Councillor Mark Carter. The Committee proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Alistair Cameron, Aaron Carey, Mark Carter, John Cole, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Michelle Wiggins, Iwan Ward, Tony Wilcox, Jacob Williams and Michael Williams. RESOLVED That the application be APPROVED, subject to the conditions outlined in Section 1.1 of the report of the Director of Community Services.
This application was for Committee consideration as it was for an office building (B1 use class) over 1000 square metres in floorspace (paragraph 1(c) of the scheme of delegation). The Committee was advised that due notification had been received from the following interested party who wished to exercise his right to address the Committee: · Agent - Mr Matthew Jones Following Mr Jones’ address, Councillor Tim Evans requested clarification as to the number of EV charging points which would be positioned on the site. Mr Jones advised that no EV charging points had been planned for the site currently, although if following a full assessment of the site there was an appetite for them, then this could be looked at, at a later stage. In response to a question from Councillor John Cole, the Head of Planning advised that the provision of EV charging points was not currently part of national or local policy, but it could be looked at as part of Local Development Plan policies in future and added that she was aware that such requirements had already been included as part of national residential policies, but not commercial policies at this stage. Councillor Brian Hall Moved that the application be approved as recommended; Seconded by Councillor Andrew Edwards. RESOLVED That the application be APPROVED, subject to a Section 106 legal agreement for the provision of a financial contribution to affordable housing should the apartments be used as sole or main residences rather than holiday let units, and the conditions outlined in Section 1.1 of the report of the Director of Community Services.
This application was for Committee consideration as the proposed development was contrary to the development plan but was being recommended for approval (paragraph 1(i) of the scheme of delegation. The Planning Officer, Amy Lack-Croft, provided an oral update stating that paragraph 1.1 (Recommendation) of the report made reference to a section 106 agreement but did not specify what obligation was required. It was advised that the obligation would be for the provision of a financial contribution to affordable housing, should the apartments be used as sole or main residences instead of holiday let units. The Committee was advised that due notification had been received from the following interested party who wished to exercise his right to address the Committee: · Agent – Mr Rob Howell Following Mr Howell’s address, Councillor Tim Evans queried if the pitch of the proposed building roof would now be higher or lower than the initial proposal. Mr Howell advised that the eaves level was comparable and that the ridge height had been raised approx. 300-400 millimetres. Councillor Alistair Cameron requested further information regarding the flood risk to the site, to which Mr Howell advised that the annual flood event was based on statistics of rainfall and tides and that the building had been designed over a lifespan of 100 years, which included flood mitigation in line with predicted climate change elements. The Committee proceeded to discuss the application and the key points were noted as follows: · Councillor Alistair Cameron made reference to the comments raised by Natural Resources Wales (NRW) and requested further information on that matter along with further information as to what assessments the Authority had conducted in relation to rising water levels. The Chief Planning Officer provided information regarding the health and safety element of policy GN.1 under which flood risk was considered along with Welsh Government guidance and the role NRW play in determining flood risk of a development. It was confirmed that the development was in a flood risk area but the Authority were satisfied that any consequences of the flooding events for the ground floor element could be managed and that there was no significant impact in terms of health and safety due to the residential units access being on a higher level. It was noted that NRW had confirmed that the flood consequences assessment had passed the technical analysis. · In response to a query from Councillor Tim Evans regarding the Town Councils expression of support, subject to the prevention of new developments being used as holiday lets, the Chief Planning Officer advised that following recent changes made by Welsh Government to the planning use classes order, planning could restrict a permitted change of use if there was evidence of an adverse impact on a community associated with an excessive number of holiday let units. The Authority did not deem a restriction to be necessary in this instance. · Following a question from Councillor Tim Evans regarding parking provision on site, the Planning Officer advised that it was a car free development, and that public parking was available nearby. Councillor Jordan Ryan Moved that the application be approved as per the updated recommendation outlined within the oral update; Seconded by Councillor Brian Hall. The Committee proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Alistair Cameron, Mark Carter, John Cole, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Michelle Wiggins, Iwan Ward, Tony Wilcox, Jacob Williams and Michael Williams. [14] There were no votes against the motion or abstentions.
