RESOLVED That the application be APPROVED, subject to the conditions outlined in Section 1.1 of the report of the Director of Community Services but with the following changes to conditions one and three; · Condition one to state: A maximum 2 year period commencing from the date any permission is issued with removal of caravans at end of time period · Condition three to state: Foul drainage to be directed to the package treatment plant
This application was for Committee consideration as the application was for development contrary to the Development Plan but which was being recommended for approval (paragraph 1(n) of the scheme of delegation). The Planning Officer, Kane Thomas, provided two oral updates as follows: • At the time of submission, the application form stated that the proposed development had not commenced and it was drawn to the Planning department’s attention that caravans had been placed on the site since submission. Such information does not change the proposed conditions in the recommendation, as condition 1 refers to the permission being for a 2 year period. However for clarification, this condition will be worded as being for a maximum 2 year period commencing from the date any permission is issued. In addition, an informative would be added to the decision notice asking the developer to notify the Department of the date the caravans have been removed from the site. • Condition 3 in the recommendation stated that details of the package treatment plant would need to be submitted for approval. The agent has supplied details of the package treatment plant installed and therefore the condition will refer to foul drainage being directed to this installation. The Committee proceeded to discuss the application and the key points were noted as follows: · Councillor Mark Carter, Local Member, expressed that although it had been disappointing to have to consider the application in a retrospective manner, he did support the development and hoped that the applicants would adhere to the requirement of the caravan removal within the stated timeframe. Councillor Mark Carter Moved that the application be approved as updated in the oral update; Seconded by Councillor Andrew Edwards · In response to a question from Councillor Tim Evans, the Planning Officer confirmed that the caravans would be within the boundary of the property being constructed, although in response to a further question on the matter from the Chairman, stated that he had not revisited the site since the caravans had been positioned. The Chief Planning Officer added that the position of the caravans can be checked to ensure they are in accordance with the consent. Councillor Mark Carter stated that in his opinion as Local Member, the caravans were in the correct position. · Following a request for further information by Councillor Tim Evans, the Planning Officer and Chief Planning Officer provided further details of the reasoning which had been given by the applicants as to why the caravans were placed on site prematurely, which had been deemed genuine reasoning. · In response to a question raised by Councillor Michael Williams, the Chief Planning Officer provided details as to reasons which would demonstrate the need for the applicants to live on site during the construction of the property. The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Alistair Cameron, Aaron Carey, Mark Carter, John Cole, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Iwan Ward, Michelle Wiggins, Tony Wilcox, Jacob Williams and Michael Williams.
