RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then resumed in open session and announced the following decision: DECISION The Sub-Committee has carefully considered all of the representations, both written and verbal, made before it by all parties. Specifically, this includes the representations made by the responsible authorities and the other person objecting to the application. The Sub-Committee heard from the applicant with considerable detail about the application, with reference also to the comprehensive natureof the event management plan. The Sub-Committee is satisfied that the applicant has worked effectively with the Police Licensing Officer and the Pollution Control Officer and has agreed with the suggested conditions which will be imposed. The Sub-Committee considers that the applicant has mediated effectively with the responsible authoritieswhich made representations. The Sub-Committee has considered the application on its merits, enhanced by the representations it has heard from the applicant. The Sub-Committee considers that the application as presented before the Sub-Committee addresses all the issues raised by the other person who made representations. The Sub-Committee recognises and understands the concerns of the objector but it is satisfied that the applicant has taken all steps to minimise the concerns. The Sub-Committee is satisfied that the application as detailed before the Sub-Committee promotes all 4 licensing objectives inasmuch as they are in issue. To clarify, this means a 10pm cessation of all licensable activities at that part of the licensed area being the Sunset Stage, as agreed by the applicant and as contained already in the application. RESOLVED That the application be granted.

The Sub-Committee then resumed and announced the following decision: DECISION The Sub-Committee has carefully considered all representations made before it from all parties, both written and spoken. The Sub-Committee is tasked with deciding whether the applicant is a fit and proper person to be granted a licence. The Sub-Committee in deciding this has as its primary consideration public safety. The Sub-Committee has taken into account all matters pertaining to the applicant which are before it. Having regard to the relevant sections of the Council’s adopted Guidance on Determining the Suitability of Applicants and Licensees in the Hackney & Private Hire Trades, and its own Policy with the same name, the Sub-Committee must treat Cautions in exactly the same way as convictions. It is within the Policies of the Sub-Committee to refuse the application, and in the consideration of the Sub-Committee the applicant has failed to provide sufficiently persuasive reasons for the Sub-Committee to depart from its Policies. The Sub-Committee is satisfied in accordance with its Policies that the earliest the applicant would be eligible to apply for a licence is March 2024. As stated above, the Sub-Committee’s main deliberation has been about whether there are exceptional circumstances to depart from its policy and grant a licence earlier. The Sub-Committee is not satisfied that there are such exceptional circumstances. The Sub-Committee finds that the Police acted entirely properly in bringing this matter to the Council’s attention. The applicant has been unable to counter these matters to the satisfaction of the Sub-Committee. As the primary concern of the Sub-Committee is the issue of public safety, it considers it is entitled to find that the applicant is not a fit and proper person, nor safe and suitable, to be granted a licence, and the application is refused. RESOLVED That the application be refused.
Moved by Councillor Tim Evans; Seconded by Councillor John Cole RESOLVED That the Minutes of the meeting held on 4 March 2022 be approved as a correct record.

The Sub-Committee considered a report by the Director of Community Services regarding a new Premises Licence application from Westival Ltd for Westival, Shipping Farm, Manorbier, Tenby SA70 8LE. It was noted that one letter of objection had been received from one other person, being a local resident, who was not in attendance at the meeting. Mr Joseph Worley, who was present on behalf of the applicant, made representations and answered questions put by Members of the Sub-Committee. In response to questions from the Sub-Committee, the applicant’s representative clarified a number of matters including measures to prevent or minimise noise disruption, traffic management measures, health and safety measures, and medical and security measures. The Lead Officer (Licensing) advised that a previous premises licence had been granted in 2020 allowing operation of the licence until 3am but, due to the pandemic, this licence had not been used. The Licensing Officer from Dyfed-Powys Police clarified that the applicant had fully engaged with the Pollution Control Officers following the event in 2018 and 2019 and that very few noise complaints were received in 2019. He further advised that Officers would be in attendance together with Local Authority Officers throughout the event. The Legal Adviser outlined the options for consideration by the Sub-Committee. The Sub-Committee then retired to undertake its consideration of the matter and the representations submitted. RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act.
