The Chair welcomed all to the meeting. The Premises License Holder did not attend the meeting. It was confirmed that the Legal Regulatory Service Section had written, on 28 November 2025 and 2 December 2025, notifying the Premises Licence Holder of the hearing. No response had been received in respect of this and, additionally, further attempts to make contact by telephone also failed. In the absence of any application for an adjournment, or explanation for the non-attendance by the Premises Licence Holder, subsequently, the Sub-Committee Resolved to proceed in the absence of the Premises Licence Holder, in accordance with r.20 of the Licensing Act 2003 (Hearings) Regulations 2005.
There were no declarations of interest received.
There were no urgent items.
At the commencement of the hearing, the Chair welcomed all parties to the meeting, made introductions and outlined the procedure to be followed. Mr N. Chapple, Legal Regulatory Services Manager, introduced the report and outlined the key points in relation to the application. The Sub-Committee heard representation from Home Offices Immigrations Enforcement Licensing Compliance Team, the South Wales Police Licensing Officer, and the Legal Regulatory Services Officer on behalf of the Licensing Authority. Decision With a view to ensuring the promotion of the four licensing objectives, in particular the prevention of crime and disorder, and in accordance with the principles of the Council’s own ‘Statement of Licensing Policy (2021)’, and the provisions of the Statutory Guidance issued under s.182 of the Licensing Act 2003, the Sub-Committee Resolved to Revoke the premises licence. Reasons In reaching a determination, the Sub-Committee concluded the following: 1. Overall, the Sub-Committee considered the representations and evidence from the Home Office (Immigration Enforcement); South Wales Police, and Legal Regulatory Service were compelling and relevant. 2. Members were mindful that the Licensing Objective relating to the prevention of crime and disorder includes the prevention of immigration offences and, in particular, illegal working in a licenced premises. 3. The Sub-Committee had regard to the history of the Premises and expressed disappointment that it had now become associated with illegal working. The Council encourages and supports well managed and complaint businesses. The grant of a premises licence is not an automatic entitlement but a privilege, and licence holders should expect scrutiny where evidence emerges of suspected unlawful conduct. 4. The Sub-Committee noted the matters relating to the fixed penalty and failure to adhere to some premises licence conditions. However, it regarded the employment of an individual without the right to work in the UK as an issue of particular gravity. Paragraphs 11.27 and 11.28 of the s.182 Statutory Guidance emphasised that certain criminal activities connected to licensed premises – including the employment of persons disqualified from such work by reason of their immigration status – must be treated with the utmost seriousness. Additionally, the s.182 Guidance finds that where the Licensing Objective of the prevention of crime and disorder has been undermined, revocation of the premises licence should be seriously considered, even in the first instance. 5. Members treated matters of this nature with the most extreme seriousness. Such conduct not only contravened immigration legislation but also eroded public confidence in the management of the Premises, and posed risks to the promotion and integrity of the licensing regime. 6. Having carefully considered the evidence presented, the Sub-Committee was satisfied, on the balance of probabilities, that an individual without the right to work to work in the UK had been employed at the Premises – contrary to Paragraph 10.8 of the Council’s Statement of Licensing Policy. Importantly, this was not a matter of oversight or administrative error; but a conscious and wilful breach that reflected poorly on the ability of the Premises Licence Holder to hold a premises licence. Members regarded this as a deliberate and intentional breach of the law, and a serious failure to uphold and promote the Licensing Objective of the prevention of crime and disorder.
