Councillor J Thomas declared a personal and prejudicial interest in Item 4 – private hire vehicle licence as he currently holds a licence.
In order for the following to be considered in private, it is suggested that the public be excluded from the meeting on the grounds that it involves the likely disclosure of exempt information as defined under Part 4 of Schedule 12A Section 100 (A) (4) of the Local Government Act 1972

The Director of Neighbourhood Services introduced the report to the committee and outlined the salient points. In response to questions officers confirmed the following; · The applicant’s agents are actively working on the detailed application, but no date for submission has been indicated. Discussions have been ongoing since January, but officers will ask the agent for an indication of timescales, and the response will be shared with the committee members · The Section 106 agreement obligations are those set out in the report put to committee back in January. It relates to the land needed for biodiversity enhancements. The obligations have been agreed; only the technical legal wording remain. · The number of conditions is normal for a development of this scale and have been agreed with the applicant. Removing any necessary conditions could expose the authority and applicant to legal challenges and they are there to protect both parties. · If a legal challenge was to occur, then yes, there could be financial implications. · Any planning permission is subject to a six-week period during which a judicial review may be sought. That is true of all planning permissions. · Officers have no way of knowing if a judicial review is expected, anyone may apply for a judicial review but must meet a legal threshold. Councillors must simply ensure decisions are made lawfully and transparently. Resolved that: The amended conditions as outlined in the report be approved.

The Planning Office D Cross introduced the report and provided a power point presentation to the committee. In response to questions officers confirmed the following; · We cannot confirm the total number of bungalows, but there is at least one nearby. The assessment is based on overall character rather than requiring every property to be identical. A bungalow in this location was not considered harmful to the character of the area. · The area contains a variety of house types and designs and officers did not consider the bungalow to be harmful to local character. The existence of another bungalow nearby was a consideration but not the only consideration. · The photographs supplied by the objectors indicate heavier parking at certain times, and officers acknowledged that parking levels appear to vary throughout the day. · Officers agreed that including images that accurately reflect evening parking conditions was something that could be considered for future applications. · The developer would bear the cost of any diversion works as Welsh Water would not fund relocation of the sewer. · Prior to any development works starting, Welsh Water would need to agree the diversion of the sewer. Resolved that: The application be approved subject to the conditions outlined in the report.

The Planning Officer G Davies introduced the item and provided a power point presentation for the members. The Deputy Leader Councillor D Jones addressed the committee on behalf of local residents and raised a number of significant concerns. The main points were: 1. Insufficient environmental information 2. Site assessed after clearance work 3. Biodiversity concerns 4. Concerns about biodiversity net benefit claims 5. Landscape impact 6. Public confidence in the planning process 7. Alleged tipping of materials 8. Sustainable Drainage (SuDS) concerns In response to questions officers confirmed the following; · The application can be deferred, but neither party can be compelled to attend. Under the constitution, public speaking is usually permitted only once, although exceptional circumstances may allow further speaking with the Chair’s agreement. · The enforcement investigations concern separate areas of land outside the application site and determining this application would not prejudice ongoing enforcement action. · No specific reasons were provided as to why the applicant didn’t wish to address the committee. The objector had sought to address the committee, but the registration deadline was missed. · Publication of the application included four site notices and regulations allow publicity by site notices, neighbour letters, or both. Because no properties directly adjoining the site, site notices were considered the most appropriate method. · The Council ecologist was consulted and raised no objection. Officers noted some vegetation removal had occurred, but much of the application site had long been hardstanding and previous aerial photography was considered. · Officers did not report alleged illegal tipping, drainage works or waste disposal, officers advised the objector to contact Natural Resources Wales (NRW) The Monitoring Officer addressed the committee to confirm that the Constitution allows public speaking on a deferred application in exceptional circumstances and with the Chair’s agreement. Resolved that: The application be deferred to the September Planning, Regulatory and Licensing Committee and that the applicant and objector would be given the opportunity to speak, subject to the constitutional provisions.
