The Planning Officer D Cross presented the detailed report including site context, proposed layout, ecological enhancements, house types and consultation responses. In response to questions raised by committee members, Planning Officers advised that: · The lack of three-bedroom properties may be due to several factors; the developer worked with Strategic Housing Department to meet identified needs. There isn’t an explanation in the application; however, there is likely a higher demand locally for one and two-bedroom properties and layout constraints may have influenced the numbers · Welsh Water have a ‘holding objection’ until all onsite drainage solutions have been explored by the developer, these will be addressed by the Sustainable Drainage Systems Approval Body (SAB) and as part of this Welsh Water will be consulted. · The contaminants found on the site are elevated levels of Polycyclic Aromatic Hydrocarbons (PAH), lead and arsenic and mitigation includes the use of membranes and 600mm of clean topsoil for landscaped areas. · There are no proposals to change existing pathways between Hillcrest and Garden City and the active travel route remains in place. · In relation to the objection relating to loss of aspect, this site was allocated in the LDP for development and the developer has designed sensitively with two storey frontages. Some loss of openness is unavoidable and is not a ground for refusal. · Detailed discussions took place between the developer and the Highways Department regarding access however there was no request from the Highways Department to widen the existing access road. Resolved that: The application be approved subject to the conditions outlined in the report.

Councillor E Galsworthy left the meeting. The Planning Officer D Cross presented the report and provided a power point presentation. Local Elected Member Cllr D Roberts addressed the committee and outline the concerns of the residents. Specific reference was made to over-intensification and harm to residential amenity, parking stress and highway safety, the proximity to schools and a children’s home, along with fears of transient occupancy and community impact. In response to questions raised by committee members, Planning Officers advised that: · Google images are used to show wider context alongside site photographs; any image is a snapshot in time. The report does acknowledge on?street congestion; and the google images are not presented to imply capacity · No management plan was submitted in the application. Day?to?day management of an HMO lies outside planning control; issues such as noise, anti-social behaviour, waste, or housing standards would be matters for the owner, Police or Environmental Health. · In relation to residential amenity and intensity of use a single dwelling could already lawfully be occupied by up to six people living as one household, and converting a room to a fifth bedroom does not itself require permission. The parking requirement (maximum three spaces) is the same for a dwelling and a small HMO; officers considered that one additional bedroom would not materially change comings and goings to a degree that justifies refusal on amenity grounds. · A licence is required where there are five or more occupants and the property has three or more storeys; the application property is two?storey, so no licence is required in this instance. Resolved that: The application be refused due to unsatisfactory impact on highway safety due to existing parking congestion in the area contrary to Policy SW11 of the Merthyr Tydfil Local Development Plan.
