Members’ views were sought as to whether to reaffirm the Planning Committee resolution (12.07.2023 - Minute No. 158) as the Committee resolution was contrary to the Officer recommendation. The Principal Planning Officer advised Members that Natural Resources Wales (NRW) had been re-consulted due to the resolution being contrary to their advice. The response included the following: · The Flood Consequence Assessment (FCA) had failed to demonstrate that the risks and consequences of flooding could be managed in accordance with Technical Advice Note (TAN) 15 (2004). · NRW would not request a call-in of the planning application. · Whether the Committee Report should include statements from the FCA that the NRW did not agree with. · The whole development should be flood free. · Concerns in respect of setting a precedent for highly vulnerable developments, which were not shown to be designed as flood free under TAN15 (AI.14). · Flood resistance measures i.e. to exclude flood waters were usually only effective for depths up to 0.6m if installed and maintained for the lifetime of the development. · That Emergency Planning Officers should be consulted. Members supported the application subject to S106 planning obligations to require affordable housing contributions and subject to planning conditions to require ‘safe refuge’ at the first floor level, further investigation and potential remediation of ground floor contamination and asbestos containing materials, and biodiversity mitigation an enhancement measures.
