Members’ views were sought as to whether to reaffirm the Planning Committee resolution (28.09.2022) to be ‘minded to refuse planning permission’ for the following reasons:- • The loss of woodland area and wildlife • Impact on the Conservation Area Following further consideration of the application, reference was made to the following: · The loss of a woodland area and wildlife was a concern. · The need to protect biodiversity was highlighted. · The location of the site was a concern as it was within close proximity to a primary school. · Highway safety. · The site was located within a Conservation Area and should therefore be preserved. · Lack of affordable housing provision on site. • The Woodland management was praised. • The need for further assessment of the site by Conwy County Borough Council’s (CCBC) Tree Officer to establish, if any additional trees shown to be retained warranted protection under a Tree Preservation Order. • Housing demand and supply The Revised Local Development Plan (LDP) and the need to include more realistic housing requirements. The Development and Building Control Manager advised that the site fell within the Settlement Boundary of Penmaenmawr and explained that for the principle of residential development it was policy compliant. In addition, the Head of Law and Governance advised on the designation of a Conservation Area. Members resolved not to reaffirm the Planning Committee’s resolution on the 28 September, 2002, and supported the application, subject to further assessment of the site by CCBC’s Tree Officer to establish, if any additional trees shown to be retained warranted protection under a Tree Preservation Order. Further to August 2022 Planning Committee, the application was deferred pending further assessment of traffic speeds and the driveway gradient. Mr Robin Gilliver spoke against the application, Mr Jamie Bradshaw (Agent) spoke in favour and the Chair, read out a statement on behalf of the Local Electoral Division Member for Eirias, Councillor Gail Jones, who was unable to attend the meeting. An addendum to the report was presented, highlighting the following: • An additional speed survey had been submitted, which was currently out for consultation. The consultation period expired on 27 October 2022, therefore, delegated authority to officers was sought to consider any further representations received. • Observations from Colwyn Bay Town Council, Building Control and the Highway Authority. • The receipt of 3 further representations/objections. • Applicant response to the objections received. • The Planning Authority were now satisfied that the issue relating to the gradient of the access lane had been resolved and as a consequence, the recommendation in the Committee report was amended accordingly. The majority of Members supported the application as it provided affordable housing, an updated speed survey had been submitted, as requested by Members previously, and the access issues resolved. However, some concern was expressed that the development did not provide a lift within the apartment building, and the Local Electoral Division Member for Colwyn highlighted concerns surrounding highway safety and traffic congestion on the Marine Roundabout, particularly at peak times. In response, the Development and Building Control Manager reiterated the Highway Authority observations and stated that provision for Active Travel improvements had been negotiated with the applicant. RESOLVED: (a) That the Planning Committee be minded to grant conditional planning permission, subject to: i) The consideration of any further representations received within the publicity period; and ii) The applicant entering into a legal agreement to deliver planning obligations, including: i) on-site affordable housing; and ii) commuted sums towards waste provision, off-site open space and highway improvements. Further to a site inspection, Neil Coverley (Chair of Colwyn Bay Football Club) spoke in favour of the application. In the interest of transparency, the Head of Law and Governance advised Members that Councillor Coverley was speaking in his capacity as Chair of Colwyn Bay Football Club and not as a County Councillor. Accordingly, Mr Coverley left the meeting following his address to the Committee. An addendum to the report was presented, highlighting observations from the following: • The National Trust. • The Highway Authority. • Colwyn Bay Town Council. • The receipt of two representations from neighbouring residents, noting the potential for further noise and disturbance from additional cars and supporters accessing the site, as well as potential impacts on highway safety and protected species, such as badgers. Officers considered it appropriate to include a condition on any permission requiring the submission of a landscaping plan for the site, together with further conditions including biodiversity enhancement, lighting, drainage and a Construction Method Statement, if permission was granted. In terms of the Highway’s observations, the Principal Planning Officer advised that such changes could be accommodated within the site and as a consequence, delegated authority was sought to deal with any amendments to plans in regards to their requests. A revised recommendation to that within the Committee report was presented. Members of the Committee considered the site to be a great asset and facility to the local community and were supportive of the proposal, subject to appropriate lighting, to avoid light pollution, suitable parking to avoid congestion on the highway and surrounding residential area and adequate drainage. RESOLVED: (a) That the Planning Committee be minded to grant conditional planning permission, subject to highway matters being resolved to the satisfaction of the Development and Building Control Manager within three months of the date of the Committee. (b) That, in the event that highway matters are not resolved to the satisfaction of the Development and Building Control Manager within three months of the date of the Committee, planning permission be minded to refuse. (c) That the Development and Building Control Manager be authorised to determine the application under delegation.
