RESOLVED- That the Cabinet decision of 10 January, 2023 (minute 524 refers) be supported, subject to the following amendment: That the Economy and Place Overview and Scrutiny Committee support the Cabinet proposal to move forward with the development of a draft Houses in Multiple Occupation HMO policy, subject to it being presented back to the Economy and Place Overview and Scrutiny Committee for further consideration, prior to approval.
The Cabinet decision on 10 January 2023 in relation to the Houses in Multiple Occupation (HMO) Study (supporting Replacement Local Development Plan evidence base) (minute 524) was called-in for the following reasons: • Members responsible for the call-in, Councillors Louise Emery, Samantha Cotton, Frank Bradfield, Anthony Bertola, Harry Saville and Thomas Montgomery, felt that the decision made by Cabinet was fundamentally different to the Scrutiny Committee recommendation (despite the Cabinet resolution containing several safeguards). · Councillor Louise Emery presented the call-in and reiterated that on 1 December, 2022 the Economy and Place Overview and Scrutiny Committee did not support the study/evidence at this current stage and requested that Cabinet take on board the concerns raised by the Committee and consider amending the policy approach accordingly. However, Cabinet resolved: (a) That the key findings and recommendations of the Houses in Multiple Occupation (HMO) Study, recognising the implications for policy changes in the Replacement Local Development Plan (RLDP) be approved, subject to: (i) the inclusion of monitoring indicators in the Replacement Local Development Plan specifically for HMOs, to enable the HMO Policy to be reviewed quickly if any unacceptable impacts or an over-concentration have been found; and (ii) the final Policy is brought back to Cabinet ahead of RLDP deposit and that it includes: · a requirement for large HMOs to have a management plan (this should alleviate concerns about absent landlords neglecting properties); and · an upper limit on occupancy numbers is put on the large HMOs (taking into account community and tourism impact). NOTE: At this point in the proceedings, a vote was taken to seek Members views on whether Cabinet Members present in the meeting should remain in the meeting to listen to the debate. Following a vote, it was unanimously agreed that the Cabinet Members should remain in the meeting. Councillor Emery also made reference to the following concerns: · It was acknowledged that the Cabinet Member had taken on board some of the concerns raised by the Scrutiny Committee, however, it was felt by some Members that not enough assurance had been provided in relation to the following: o The misconception of a blanket ban on HMOs – it was reported that Conwy County Borough Council had lost 4 appeals in the past 11 years. o Whilst Cabinet had stated that large HMOs would have a Management Plan, which would assist in alleviating some of the concerns regarding absent landlord’s neglecting properties, clarity was sought in terms of how the Management Plan would work and who would manage it. o Clarity was also sought in terms of the proposed upper limits and occupancy numbers put on large HMOs. o The reassurance that the Holiday Accommodation Zone would take preference over HMOs was welcomed. o Concern was expressed that the Policy would allow the option for more inappropriate housing when there was a real need for suitable housing for young people, families and vulnerable people. o On the evidence presented by Litchfields Planning and Development Consultancy, consideration should be given to leaving the current policy in place. · The need for safe, suitable housing to be built by CCBC and/or Registered Social Landlords (RSLs) was highlighted. In addition, a supporter of the ‘call-in’, Councillor Harry Saville, made reference to previous comments raised by the Economy and Place Overview and Scrutiny Committee in relation to safeguarding concerns, potential hygiene concerns, in terms of shared bathroom facilities, the Holiday Accommodation Zone and the need for investment in good quality social housing. In scrutinising the call-in, Members made reference to the following: • A Member of the Committee, who had previously campaigned vigorously, for the implementation of special HMO control measures in areas, such as Colwyn Bay and Pensarn, provided some background to the past problems faced by HMOs and stated how provision and enforcement had improved significantly with the assistance of partners, Planning Regulations and the use of Management Plans and Environmental Polices. · Whilst there were some concerns regarding the Cabinet recommendation, the majority of Members were satisfied that moving forward with the development of a draft policy, as per the Cabinet recommendation, was acceptable, subject to the draft policy being presented to the Economy and Place Overview and Scrutiny Committee for further consideration in due course. · The growing homelessness crisis and the need to house those in need urgently, until further social housing could be sourced/built, was highlighted. · The Leader of the Council made reference to the flexible nature of the previous scrutiny recommendation and requested a clear steer from Members as to what exactly they wanted Cabinet to consider. · In addition, the Strategic Planning Policy Manager made reference to market values, the various consultation stages in relation to the Replacement Local Development Plan and assurance was provided to Members that the current HMO policy would remain in force until the Replacement Local Development Plan (RLDP) had been adopted. In scrutinising the call-in, the following proposals were put forward: • That, on the evidence presented by Litchfields, the Economy and Place Overview and Scrutiny Committee recommend to Cabinet that the current HMO policy remains in place. • That the Economy and Place Overview and Scrutiny Committee support the proposal to move forward with the development of a revised draft HMO policy and present it back to Committee for further consideration, prior to approval. Following a vote it was: RECOMMENDED TO CABINET: RESOLVED- That the Cabinet decision of 10 January, 2023 (minute 524 refers) be supported, subject to the following amendment: That the Economy and Place Overview and Scrutiny Committee support the Cabinet proposal to move forward with the development of a draft Houses in Multiple Occupation HMO policy, subject to it being presented back to the Economy and Place Overview and Scrutiny Committee for further consideration, prior to approval.

RESOLVED: That the update on Net Zero Carbon Performance be noted.
The Cabinet Member for Environment, Roads and Facilities – Neighbourhood and the Environment introduced the Net Zero Carbon Performance Report and the Carbon Management Officer provided Members with an update on the following: · Following the national and local climate emergency declarations in 2019, Welsh Government set out its commitment to achieve net zero carbon emissions by 2050 and decarbonise the public sector by 2030. · Conwy County Borough Council (CCBC) had declared a climate emergency and set out its commitment to achieve net zero by 2030. The Council had responded proactively to the national direction and in December 2020, the Council’s Decarbonisation Plan received unanimous democratic approval. · CCBC had established a new carbon equivalent baseline aligned to the national net zero reporting requirements developed by Welsh Government. The baseline year was now 2019/2020, with a widened scope, including additional elements to what had been measured and reported historically, such as supply chain and staff commuting. · In 2021/2022 Welsh Government amended the reporting guidance to include emissions from homeworking and municipal waste. · Future carbon equivalent performance of this scope would be compared to the new baseline year of 2019/2020, whereas previously performance had been compared to that of 2010/2011. Members welcomed the informative update and went on to discuss the following: · What impact did Leisure Centres have on the environment and what measures were being taken to reduce energy costs/output? - In response, the Carbon Management Officer advised that CCBC had a Net Zero Estates Project and one of the tasks was to develop a decarbonisation strategy. · Comparisons with other Local Authorities – Members were informed that whilst currently, the reporting scheme was voluntary, good practice was regularly shared via officer groups and forums. · Urban tree planting benefits in terms of biodiversity and carbon emission was highlighted. · Workplace charging policy and did it apply to school staff? – In response, the Carbon Management Officer advised that currently the policy was primarily for all Council staff, however; as the infrastructure available in schools for charging vehicles was limited, this might not always be possible. In addition, the grid capacity for North Wales was insufficient. · It was noted that school emissions had increased by 4%, primarily due to the increase in fuel prices. In response, the Carbon Management Officer advised that the Net Zero Estate Project was in the process of developing a strategy for decarbonising schools. In addition, energy audits of all CCBC buildings are taking place and the information/results were shared accordingly. Members requested that the Action Plans specific to schools be shared with LEA Governors for information. · CO2 equivalent (CO2e) emissions and ventilation of school buildings – CO2e was closely monitored within school settings and should levels rise, the need for additional ventilation was triggered. Whether teaching staff turned off radiators, when opening windows was not known and a matter for individual schools to address. · One place of work e.g. the office would result in one energy cost. Home working and the need to share energy saving advice and emphasise the importance of staff taking account of their own energy usage was highlighted. It was noted that staff not commuting to the office as regularly had reduced carbon emissions and as vehicles became greener and active travel increased, office working may well increase going forward. · The Staff Travel Scheme continued to search for funding/deals from external resources for charging infrastructure. · The impact of tree removal as a consequence of new housing developments. – In response, the Carbon Management Officer advised that tree removal was taken into account as part of the Ecological Impact Assessment. In addition, as part of the Ash Dieback Action Plan, a tree recovery scheme had been taken into account. · How confident were officers of achieving a Net Zero goal by 2023? - The Carbon Management Officer advised that, whilst there was much work still to do to reach the net zero target by 2030, CCBC continued to follow the Net Zero route map and follow technology advances. · Spend to save options, planting trees, to include fruit trees and the potential of large scale solar farms were also highlighted. Members thanked Officers for the informative update and continuing to provide assurance that the Authority was effectively addressing and monitoring its performance against the carbon reduction targets and its Decarbonisation Plan. RESOLVED: That the update on Net Zero Carbon Performance be noted.

RESOLVED: That the Economy and Place Overview and Scrutiny Committee note the bi-annual overview of County wide coastal and fluvial flood risk reduction schemes - February 2023 and associated appendices.
The Cabinet Member for Environment, Roads and Facilities – Infrastructure presented the bi-annual overview on County wide coastal mitigation schemes and capital works being implemented. The Flood Risk and Infrastructure Manager provided an overview of the projects delivery, phases and funding as well as an update on the flood risk mitigation measures being undertaken within the County. In addition, reference was made to Welsh Government Programmes and Conwy Projects: · Flood and Coastal Erosion Risk Management Programme · Coastal Risk Management Programme (CRMP) · Small Scale Schemes (SSS) · Resilient Roads Programme (RRP) In addition, Members were encouraged to view Appendix E, which detailed a plan identifying the location of each project and Appendix F, which provided individual project summary sheets. In scrutinising the report, Members made reference to the following: · In terms of the Coastal Defence works (Llandudno sand on the beach), a Member of the Committee sought clarity in terms of what lobbying had taken place with Central Government and whether a letter had been sent to the Secretary of State as previously requested by the Economy and Place Overview and Scrutiny Committee. In response, the Leader assured Members that CCBC was actively looking for future funding opportunities and that the Cabinet Member for Environment, Roads and Facilities - Infrastructure, together with the Deputy Leader were in regular dialogue with funding partners/Government etc. RESOLVED: That the Economy and Place Overview and Scrutiny Committee note the bi-annual overview of County wide coastal and fluvial flood risk reduction schemes - February 2023 and associated appendices.
The Strategic Engagement and Place Plan Officer, together with the Strategic Planning Policy Manager presented Members with the Towyn and Kinmel Bay Place Plan Supplementary Planning Guidance (SPG). Reference was made to the following: · Background to Supplementary Planning Guidance (SPG) and Place Plans. · The benefits of a Place Plan - Place Plans were planning documents prepared and led by communities to enable residents to have a greater say on developments within their local area. They were a way to establish the important development issues for communities and agree ways to address those in the future. · Reference was made to consultation with the community via Towyn and Kinmel Bay (TKB) Town Council – in June 2021, the Town Council submitted the Community Connections project to UK Government’s Community Renewal Fund, with a focus on the development of a Place Plan. The project objectives were to encourage greater community engagement in local planning and wellbeing, influence delivery plans of public sector bodies and deliver tangible improvement. In December, 2021 the Town Council was successful in securing the funding, which led to the creation of a Place Plan. · There was also a recognition that the community lacked a wider partnership approach. As such, in March 2022, the TKB Voice Community Partnership was formed, providing a conduit for local conversations, prioritising and making things happen. · Throughout the development of the Place Plan, numerous consultation sessions were held across the community as well as the creation of the lead group TKB Voice, who had overseen the process with regular meetings to discuss the findings of each session. Full details of the consultation approach were contained within Appendix 1 of the Committee report. · Throughout the consultation process, engagement had been held with other Conwy County Borough Council services, including Highways, Education, Environment, Roads and Facilities, Active Travel and Planning to ensure the themes and projects were considered deliverable. The report sought approval to undertake a 6 week consultation exercise on the draft TKB Place Plan SPG. Members were supportive of the Place Plan and consultation and thanked both Officers and the Leader for their continued support. RECOMMENDATION TO CABINET That the Towyn and Kinmel Bay Place Plan Supplementary Planning Guidance be approved for consultation.
