The Licensing Sub-Committee had been convened to determine an application for a variation of a premises licence at Llanfairfechan Golf Club, Llanfairfechan, Conwy. The Chair outlined the format of the hearing, confirmed the role of the Licensing Sub-Committee and introduced the Members of the Committee and officers to those present at the Hearing. At the conclusion of the meeting, the public hearing would be closed and the Members, Committee Services Officer and Solicitor would retire, in private, for Members to deliberate. Following discussion by Members, a decision would then be prepared and be issued in writing within 5 working days of the Hearing. The following parties were present to make representations: Jean Williams – Premises Licence Holder and Hefyn Edwards - Treasurer Following mediation, the Applicant had agreed to amend the Application such that: • The proposed hours of operation for live and recorded music be amended and only be authorised (indoors) inside the Premises from 23:00 (there would be no outdoor music after this time). • The Premises would carry out a noise assessment prior to any event involving live music. • A phone number would be published on the club website, for any person within the immediate vicinity to report any disturbance caused by regulated entertainment. • The Premises would operate late night refreshment (the sale of hot food and drinks) in line with the sale of alcohol, currently 02:00 on a Friday, Saturday and public holidays. The Application before the Sub-Committee was for a variation of a Premises Licence to extend the terminal hours for licensable activities and to remove a number of conditions from the licence which the Applicant considered were no longer relevant. Relevant representations were submitted by the applicant. The Sub-Committee was required to determine the application, taking into account all relevant factors/evidence and then retired to deliberate. During deliberations the Solicitor and Committee Services Officer were present. The Solicitor was called upon for advice on drafting issues on the reasons for the recommendations. The Application had been considered in the context of the four statutory licensing objectives (the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm), the Licensing Act 2003, the Statutory national guidance (section 182 Guidance), the Council’s own Statement of Licensing Policy, the protocol for Members’ Hearings, the rules of natural justice and duties and responsibilities placed upon the Council in relation to Section 17 of the Crime and Disorder Act 1998 and the Human Rights Act 1998. Members were satisfied that the measures put in place by the Applicant and proposed as further conditions following mediation provided sufficient assurance that any noise nuisance would be minimised. Furthermore, Members reiterated that the behaviour of members of the public on leaving the premises was a matter for their own personal responsibility and also noted that there had been no complaints made to the Licensing Authority in respect of the premises. Members were reassured that there had been no representations made by responsible authorities, particularly the Police or Environmental Health. In respect of the conditions which the Applicant had requested be removed, Members noted that there was no evidence before them in respect of those requests other than the Application itself. Members considered the condition requiring notices to be displayed at all exits advising customers to have consideration to neighbours to be relevant to the objections received and felt that this condition supported the other measures proposed by the Applicant to address issues of potential noise. Members were pleased to hear that staff and DJs issued reminders at the end of events and noted the Applicant’s commitment to complying with the licensing requirements. Having considered all the representations made in writing and at the hearing, including the measures that the Applicant had agreed to implement in dealing with any potential noise issues, the Sub-Committee concluded that it would be possible to overcome the objective of Public Nuisance. Following a unanimous vote, it was RESOLVED: That the Licensing Sub-Committee grant the application to vary the Premises Licence as per the application as amended following mediation, subject to the usual mandatory licensing conditions and the conditions already attached to the Premises Licence, subject to the removal of the following conditions;: • The Premises will host a community meeting on a 3/6 month basis. All functions will be reviewed and where practical attendees of the community meeting will be notified in advance. • At the “Big” annual charity event, Security Industry Authority (SIA) licensed security staff will be employed. • At the “Big” annual charity event plastic glasses will be used.
