Councillor Harry Saville presented an application for the renewal of a dispensation for matters relating to taxi licensing and home to school transport due to a family member’s connection, employment and interests concerning Phoenix Transport Ltd., a private hire company and contracting partner with the Local Authority providing home to school transport. Councillor Saville confirmed that, whilst his application remained unchanged, he was content with the level of dispensation that had been granted previously. Committee Members went into private session to seek advice on the application and determine the application. RESOLVED: That the application for dispensation to allow Councillor Jo Nuttall to speak with officers, to write to officers and or the Council, to speak and/or answer questions at Council/Committee meetings, to remain in the room, or to vote during any debate relating to Public Spaces Protection Dog Orders (PSPO) be refused. Note: Councillor Ann Jones declared a personal and prejudicial interest in the above agenda item as she is friends with Councillor Nutall. Councillor Jo Nutall declared a personal interest in the above agenda item as it was her application, however, the Committee had invited Councillor Nuttall to explain the reasons for the application.
Councillor Jo Nuttall presented an application for a dispensation for matters relating to Public Spaces Protection Dog Orders (PSPO) due to her occupation as a professional dog walker and from having previously expressed views publicly regarding the proposed dog ban. Councillor Nuttall was questioned and made reference to the following: · Llandrillo-yn-Rhos electoral ward was represented by four elected Members. · She considered it important to speak and vote on behalf of residents. · Her dog-walking business operated between Penrhyn Bay and Old Colwyn, generally from approximately 8.30 am to 1.00 pm each day. She did not usually walk the dogs on the beach. · She had expressed strong views on the Public Spaces Protection Order (PSPO) and had organised a protest walk in her capacity as a member of the public, rather than as a County Councillor. · She was a member of the Economy and Place Overview and Scrutiny Committee. None of the other three ward Members served on the Committee, although one was a Cabinet Member. Committee Members went into private session to seek advice on the application and determine the application. The Monitoring Officer advised that the dispensation had not been granted due to Councillor Nuttall’s business interest and her involvement in organising a protest in a personal capacity. The Committee was not satisfied that the nature of her interests was such that her participation in the related business would not damage public confidence in the conduct of the relevant authority’s business. It was also noted that three other ward members were able to represent their constituents’ views on the matter.
