Further to a site inspection, Andrew Hinchliff (Llanfairfechan Town Councillor) spoke against the application, Councillor Penny Andow also spoke against the application (Local Member for Llanfairfechan) and Justin Paul (Agent) spoke in favour of the application. An addendum to the report was presented, highlighting the following: · The Council’s Highways Officer was satisfied that the site layout, as currently proposed, was not unsafe as previously stated, there was other guidance such as Manual for Streets that encouraged shared use roads for pedestrians, cyclists and motorised vehicles that could be designed in a safe way. · The applicant was in discussion with the Council’s Highways Officer to widen certain parts of the footways in the site layout, in order to make the internal road suitable for adoption by the Council in the future. · Officers would recommend the use of Section 106 Legal Agreement to control the management and maintenance of unadopted roads instead of the use of condition. · Further public representations had been received from the occupiers of nos. 9 and 127 Gorwel, Llanfairfechan raising concerns in relation to traffic issues. The Senior Planning Officer advised that the Section 106 Legal Agreement should include a planning obligation to control the Scheduled Habitat Management Plan, as requested by the Council’s Ecologist. The Council’s Traffic and Transportation Engineer informed Members that an amended layout plan was being considered against adoption standards, and if the amended plan did not satisfy adoption standards he would recommend that the management and maintenance of the internal highway was controlled by planning condition. Whilst a Member considered that the planning permission should be granted in order to provide additional housing, the majority of Members considered that planning permission be refused for the following reasons: · The impact of the additional traffic generated by the proposal on the local highway network and highway safety. · The application site was outside the Local Development Plan (LDP) settlement boundary, contrary to LDP policy. The Development and Building Control Manager advised the Committee that the adoption of the proposed internal highway was not a suitable reason for refusal. The Committee was also advised that the application would need to be referred to Welsh Government Ministers, if the resolution was to grant planning permission contrary to LDP Policy. As the proposal was contrary to the officers’ recommendation, Members were informed that the application would be referred back to a future meeting of the Planning Committee for further consideration. RESOLVED- (a) That the Planning Committee be minded to refuse planning permission. (b) That the Development and Building Control Manager be authorised to determine the application under delegation. (c) That, in accordance with approved procedure, the application be referred back to the next meeting of the Planning Committee for further consideration, as the resolution was contrary to the officer’s recommendation.
