The Leader introduced the Capital Programme 2023/2024 – Outturn Position report and the Strategic Director – Finance and Resources highlighted the key points. In scrutinising the report, Members discussed the following: • The need to review and challenge corporate plan priorities to ascertain if they are still valid. • The spend profile in terms of carry-over was queried. Members were informed that a profile of spend was sought from Heads of Service in order to ascertain the likely spend profile and would be reflected in priorities for the next quarter programme. Slippage in timing when capital was spent was due to a variety of external reasons. • Borrowing in advance of spend was queried. Members were advised that borrowing only happened once spend had happened, but on occasion, consideration was given to Coastal Risk Management Programme (CRMP) schemes/projects, subject to certain criteria. The current loan profile was managed and advice regularly sought from the Authority’s Treasury Advisors. • The total spend for coastal works in Rhos on Sea was queried, together with any on-going maintenance costs and whether the Town Council would be expected to contribute to the long term maintenance costs on the promenade. In response, Members were assured that the scheme was operating within budget and information concerning the long term maintenance of the promenade would be confirmed and shared with Members accordingly. · Reference was made to the corporate risks related to capital schemes within the capital programme. Risks in relation to the deterioration of school buildings due to an inability to meet repair and maintenance requirements was highlighted. In response, Members were advised that a report would be presented to democracy in September, 2024 following the peer review to advise on the range of activity that had been undertaken to address the peer review findings and to take account of the work that CIPFA had undertaken. - • The Chair expressed disappointment that the £540k Welsh Government repairs and maintenance grant had been transferred to a new build when it could have been used to spend on school buildings. RESOLVED: That the Finance and Resources Overview and Scrutiny Committee note the contents of the report. RECOMMENDED TO CABINET: (a) That the net addition of £2.261m to the 2023/2024 capital programme be approved. (b) That the final capital outturn position for 2023/2024 of £43.176m, which includes advance spending of £0.193m relating to 2024/25 budgeted capital schemes, be noted. (c) That the remaining 2023/2024 capital programme of £81.958m be carried forward, added to the 2024/2025 capital programme and approved.
The Leader introduced the revised Capital Programme 2024/2025 - Quarter One Monitoring report and the Strategic Director – Finance and Resources highlighted the key points. In scrutinising the report, Members discussed the following: • Reference was made to variations to the Total Capital Programme highlighted in appendix 1 of the report and queried, if an evaluation of some of them should take place. In response, the Strategic Director provided an overview and advised that, in respect of the pay and display machines, she had approved the spend as it was within her delegation and the revenue budget to fund and the debt was available within the Environment, Roads and Facilities (ERF) budget. The variation in respect of housing development reflected an adjustment to the element to be funded from grant, as the level of grant funding was unknown at present. Although the report showed that the Abergele Road project was funded by borrowing, it had in fact, been funded from grant. When the grant was received it was displaced against another project and the borrowing swopped to this project. The budget should be sufficient to fund any roof repairs. • Discussion also arose regarding other displaced grant money and the future of Levelling Up funding. • A clearer explanation within reports presented to democracy on the makeup of the ‘revised estimated outturn’ was suggested. The Strategic Director acknowledged that greater detail would assist the understanding, but confirmed the data was accurate. • Concern was expressed regarding Victoria Pier (Phase 3), the reported restated estimated outturn of £9k. The Strategic Director advised that she would seek further detail from the relevant Head of Service and provide a written response to Members. Members were supportive of the recommendations, subject to the schemes carried forward from 2023/2024 being reviewed in the next quarter, with a focus on the schemes that would incur borrowing. RECOMMENDED TO CABINET: (a) That the net addition of £4.085m to the total Capital Programme be approved. (b) That the total Capital Programme of £101.643m and the first quarter capital outturn position for 2024/2025 be noted. (c) That those schemes carried forward from 2023/2024 be reviewed in the next quarter with a focus on the schemes that will incur borrowing.

The Leader introduced the Financial Outturn 2023/2024 report and the Strategic Director – Finance and Resources highlighted the key points. In scrutinising the report, the following questions were raised: · Homes for Ukraine reserves: Unspent tariff funding carried forward to fund the ongoing costs of the resettlement operation. Members were informed that as a Council, Conwy had fully utilised the funding provided, but the reserve had not been fully allocated out to services. An assessment of future need against the reserve would be made, and the remainder returned to general balances. Details would be provided in a future monitoring report. · How many redundancies were made across all services in order to balance their budgets? · How many schools used reserves to balance their budgets? · Further clarity was required in relation to the pay and display facilities at Porth Eirias and why the savings had not been reached? · Further clarity was sought as to why there was a reserve for claims in relation to Porth Eirias. Further clarity was sought as to why there had been a delay in the implementation of safer routes to school, which in turn had impacted on the savings to be achieved? The Strategic Director advised that a written response to all the questions raised would be provided. In addition, the Chief Executive thanked officers for their hard work and dedication and assured Members that with the assistance of CIPFA a report would be presented to democracy in September 2024, which would provide further clarity in terms of the proposed long term plans, controls and measures. The Leader introduced the Revenue Budget 2024/2025 - Quarter One Monitoring Report and the Strategic Director – Finance and Resources highlighted the key points and potential pressures. In scrutinising the report, Members discussed the following: • Concern was expressed that in the 1st Quarter, there was already a £5.5m forecast deficit for the year. In terms of Social Care, the Head of Service - Integrated Adult and Community Services, together with the Head of Children, Family and Safeguarding Services assured Members that although complex, Betsi Cadwaladar University Health Board and Conwy were working together to resolve any disputes, review systems, timescales, infrastructure concerns, service demand and pressures. Members welcomed the update and were supportive of the recommendation within the report, subject to all budget holders and Heads of Service, within the Authority, being reminded of their responsibility to deliver within budget. RECOMMENDED TO CABINET (a) That the latest financial assessment of the estimated budgetary position for 2024/2025 be received and noted. (b) That the virements set out in Appendix 1 of the report be approved. (c) That all budget holders and Heads of Service within the Authority are written to and reminded that they have a responsibility to deliver within budget.

RESOLVED: That the Finance and Resources Overview and Scrutiny Committee note the progress made to improve the governance and compliance of agency placements.
The Leader introduced the report on managed services provision for agency and temporary workers and the Principal HR Business Partner provided the detail. In scrutinising the report, Members made reference to the following: Members were informed that approximately 90% of services were now registered to use the provision. Work was also underway with some services to accommodate more specialist, niche or exempt vacancies. Members were advised that, whilst there was scope for the system to accommodate any type of role, in respect of school staff, there was currently a Welsh Government Framework in place for the provision, however, discussions with colleagues in Education Services had not yet taken place, but enquiries could be made. In terms of Domiciliary Care vacancies, discussions were taking place with colleagues in Social Services to review their requirements and move forward. · Members welcomed the support of the Unions and thanked officers for the inclusion of the Welsh Language skill/requirement when sourcing a suitable worker. · Concern was expressed as to why the previous framework expired in March, 2023, however, Cabinet did not approve the implementation of the new provision until 11 April, 2023 and the system didn’t go live until December, 2023. In response, the Leader advised that he would endeavour to ascertain the timeline for implementation and provide a written response to Members accordingly. RESOLVED: That the Finance and Resources Overview and Scrutiny Committee note the progress made to improve the governance and compliance of agency placements.
