RESOLVED that the report be noted.
The Committee received a Performance Monitoring report for the areas under its remit, showing the progress at End of Year 2025/26 of deliverables (Actions and Measures) linked to the Corporate Strategy and Well-being Objectives. The Committee had the following questions or comments: - The measure regarding the average number of days to deliver responsive housing repairs was discussed, and the Cabinet Member for Homes was asked whether the service improvement plan was currently being actioned. The Cabinet Member noted the difficulties in delivering housing repairs, including managing contractors and their communication with tenants, but that the team was working hard to improve on this. The Head of Housing also advised the Committee that there had been improvements over the last year, despite repair requests doubling over the last two years, and that a new manager had been appointed to oversee service improvement, focusing on expediting complex cases. The Committee was advised that housing officers were happy to speak privately regarding specific cases that were beyond the target in councillors’ wards. - The Committee asked about the measure regarding the average amount of time taken to take positive planning enforcement action and communication with local members regarding progress on cases. The Head of Place and Sustainability noted that the number of open cases past the 180 day target was above target, but that this number had reduced significantly in recent years. The Cabinet Member for Rural Affairs, Communities, and Welsh Language advised that delays in cases going to court was a significant factor impacting performance, alongside the necessity to only take cases to court where there was strong enough evidence to win. The Committee was advised that the department was determined to prosecute those who continually flout planning laws and it was noted that officers were happy to keep all members updated on enforcement cases in their wards. - The Committee placed on record its thanks for officers on the Transforming Tyisha team and their hard work. - The Committee asked a question about the grace period given before the Council Tax premium is levied on an empty house, for example in situations where the homeowner has passed away and the house is going through probate. The Housing Services Manager noted that individual situations were considered and that a sympathetic approach was taken in these cases. He noted that the service tried to understand the circumstances of a house being empty and endeavoured to use a reasonable approach to bring the house back into use, whether using the Council Tax Premium, the Empty Homes Grant, or enforcement measures. The Committee was advised that cases would only be taken to court if there was the evidence to win the case, and that the enforcement policy necessitates that the approach be transparent, proportionate and reasonable. It was also noted that the most effort was put into bringing houses back into use in the areas with the most housing need. - A question was asked regarding the accuracy of the data on empty homes; the Housing Service Manager noted that the empty homes team was informed by Council Tax of any home that had been empty for over six months. He noted that local knowledge from members could be crucial, especially on houses that were in a state of disrepair and potentially causing anti-social behaviour or public health issues. - A question was asked regarding the monitoring of Gwynedd County Council’s appeal against a court judgment in relation to its introduction of an Article 4 direction on withdrawing or limiting certain permitted development rights. The Head of Place and Sustainability noted that since the end of the period the report covered, Gwynedd County Council had been refused leave to appeal and the authority was now monitoring their potential re-implementation of the Article 4 direction, the impact of this, and any future legal challenges. This is to ensure that the authority can implement Article 4 on a legally sound basis if it decides to do so. - The Committee commended the progress on the percentage people referred to the National Exercise Referral scheme, noting that although the figure remained below target, it was improving. - A question was asked regarding access to super-fast broadband and improvements in mobile phone signal in rural areas, and what further improvements could be made. The Cabinet Member for Homes noted that he had been part of these discussions with the Chief Digital Officer and would ask him for a response to be circulated to the Committee after the meeting. - The Committee asked about the safeguarding of jobs created with regeneration funding after the end of the Shared Prosperity Fund. The Economic Development Manager noted that there was also a Local Growth Fund that was being reviewed in September 2026 and that there would be more clarity on funding programmes for March 2027 onwards at that point. UNANIMOUSLY RESOLVED that the report be noted.

RESOLVED that the updated Terms of Reference be agreed.
The Committee received a report on the amended Terms of Reference and scope of the Task and Finish Group on Homes in Multiple Occupation. The Committee had the following questions or comments: - A question was asked regarding reference to the Task & Finish group considering planning policy, and whether this should be included within the ‘purpose’ section. The Cabinet Member for Rural Affairs, Communities, and Welsh Language advised that she considered the current planning policies around HMOs to be robust and sufficient to address issues. The Housing Service Manager noted that while the main purpose was HMO licensing, the group would be able to make recommendations regarding planning policy regarding HMOs. - In response to a question regarding housing change of use from C3 (residential) to C4 (HMO) the Cabinet Member for Rural Affairs, Communities, and Welsh Language advised that this would require planning permission, was not covered under permitted development rights, and that retrospective permission would be treated the same as advance permission. The Head of Place and Sustainability added that some HMOs would come under sui generis planning permission, but that permission would still be required - The Committee asked about the alignment with wider strategic objectives, including the Local Development Plan (LDP), and how the Task & Finish Group’s findings would inform this. The Head of Place and Sustainability noted that the LDP already had policies that allowed officers or the planning committee to consider community impact as a planning consideration. It was also noted that a limit on HMOs could potentially be set as a planning policy, but that it would need to be one that could be defended in court if necessary. UNANIMOUSLY RESOLVED that the updated Terms of Reference be agreed.
