RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12 to the Local Government Act. Having regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the guidance issued by the DCMS and the Home Office, it was: FURTHER UNANIMOUSLY RESOLVED, having considered all the evidence before it, that Mr Jones’ personal licence be suspended for a period of 2 weeks. In coming to its decision, the Sub-Committee made the following findings of fact: • The licensing authority became aware of the personal licence holder’s conviction for a relevant offence via the press rather than via the personal licence holder. • The information provided by Dyfed Powys Police as to the personal licence holder’s alcohol consumption at the time of the incident was accepted. Having borne in mind the personal licence holder’s responsibilities as a personal licence holder, the Sub-Committee is satisfied that its decision (outlined above) is appropriate to promote the licensing objectives.
RESOLVED that consideration of Mr Luigi Presutti’s Personal Licence be adjourned for 1 month. REASONS In coming to its decision, the Sub-Committee made the following findings of fact; • The licensing authority’s indication that further clarification was needed from Dyfed Powys Police as to the offences being considered was accepted. The Sub-Committee was therefore satisfied that its decision (outlined above) was necessary for its consideration of the matter.
There were no declarations of Personal Interest.
