RESOLVED that dispensation be granted under Regulations 2(2)(d), 2(2)(e) and 2(2)(h) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001 to Councillor Claire Louise Thomas to speak and make written representations but NOT vote on council business at meetings of Henllanfallteg Community Council regarding matters pertaining to Llanfallteg Millenium Hall and the dispensation be valid until the end of the current electoral term.
The Committee considered an application submitted by Community Councillor Claire Louise Thomas for the grant of a dispensation under the provisions of the Standards Committees (Grant of Dispensations) (Wales) Regulations to speak and vote in relation to council business at meetings of Henllanfallteg Community Council regarding matters pertaining to Llanfallteg Millenium Hall. The Committee was advised that Councillor Thomas is a Trustee of the Millenium Hall and therefore would have a personal interest in any council business relating to the hall. It was reported that a dispensation was sought by Councillor Thomas by virtue of: Regulation 2(2)(e) the interest is common to the member and a significant proportion of the general public; Regulation 2(2)(h) the business relates to the finances or property of a voluntary organisation of whose management committee or board the councillor is a member of and the councillor has no other interest in the business; and Regulation 2(2)(g) the business to which the interest relates is to be considered by an overview and scrutiny committee of the relevant authority and the member's interest is not a pecuniary interest; The Committee considered that the following ground was also applicable to the dispensation request submitted: Regulation 2(2)(d) – the nature of the member’s interest was such that the member’s participation in the business to which the interest relates would not damage public confidence in the conduct of the relevant authority’s business. The Committee was advised that if it was minded to grant Councillor Thomas’ request it would also need to determine the duration of that dispensation. In response to a query, the Legal Services Manager clarified that Regulation 2(2)(g) would only be applicable if Henfallteg Community Council had established an overview and scrutiny committee. Following a discussion it was UNANIMOUSLY RESOLVED that dispensation be granted under Regulations 2(2)(d), 2(2)(e) and 2(2)(h) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001 to Councillor Claire Louise Thomas to speak and make written representations but NOT vote on council business at meetings of Henllanfallteg Community Council regarding matters pertaining to Llanfallteg Millenium Hall and the dispensation be valid until the end of the current electoral term.

RESOLVED that dispensation be granted under Regulations 22(2)(d), 2(2)(e) and 2(2)(h) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001 to Councillor Peter Caunt to speak and make written representations but NOT vote on council business at meetings of Henllanfallteg Community Council regarding matters pertaining to Henllanfallteg Community Association and the dispensation be valid until the end of the current electoral term.
The Committee considered an application submitted by Community Councillor Peter Caunt for the grant of a dispensation under the provisions of the Standards Committees (Grant of Dispensations) (Wales) Regulations to speak and vote in relation to council business at meetings of Henllanfallteg Community Council regarding matters pertaining to Henllanfallteg Community Association, which manages the community village hall. The Committee was advised that Councillor Caunt is the volunteer treasurer of the association and therefore would have a personal interest in any council business relating to it by virtue of paragraph 10(2)(a)(ix)(ee) of the code. A member of the public, knowing of this connection might reasonably conclude that it would influence Cllr Caunt’s judgement when considering such council business. It was reported that a dispensation was sought by Councillor Caunt by virtue of: Regulation 2(2)(e) the interest is common to the member and a significant proportion of the general public; Regulation 2(2)(h) the business relates to the finances or property of a voluntary organisation of whose management committee or board the councillor is a member of and the councillor has no other interest in the business; and Regulation 2(2)(g) the business to which the interest relates is to be considered by an overview and scrutiny committee of the relevant authority and the member's interest is not a pecuniary interest; The Committee considered that the following ground was also applicable to the dispensation request submitted: Regulation 2(2)(d) – the nature of the member’s interest was such that the member’s participation in the business to which the interest relates would not damage public confidence in the conduct of the relevant authority’s business. The Committee noted that Regulation 2(2)(g) would only be applicable if Henfallteg Community Council had established an overview and scrutiny committee. The Committee was advised that if it was minded to grant Councillor Caunt’s request it would also need to determine the duration of that dispensation. Following a discussion it was UNANIMOUSLY RESOLVED that dispensation be granted under Regulations 22(2)(d), 2(2)(e) and 2(2)(h) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001 to Councillor Peter Caunt to speak and make written representations but NOT vote on council business at meetings of Henllanfallteg Community Council regarding matters pertaining to Henllanfallteg Community Association and the dispensation be valid until the end of the current electoral term.

RESOLVED that dispensation be granted under Regulations 2(2)(d), 2(2)(e) and 2(2)(f) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001 to Councillor Keith Harding to speak and make written representations but NOT vote on council business at meetings of St Ishmael Community Council regarding matters pertaining to access to the beach at Ferryside and the dispensation be valid until the date of the next meeting of the Standards Committee [currently scheduled for 25.11.2025].
The Committee considered an application submitted by Community Councillor Keith Harding for the grant of a dispensation under the provisions of the Standards Committees (Grant of Dispensations) (Wales) Regulations to speak and vote in relation to council business at meetings of St Ishmael Community Council regarding matters pertaining to access to the beach at Ferryside. The Committee was advised that Councillor Harding lives next to the beach access point and would have a personal interest in any council business relating to this issue by virtue of paragraph 10(2)(a)(vi) of the code. A member of the public, knowing of this connection might reasonably conclude that it would influence Cllr Harding’s judgement when considering such council business. It was reported that a dispensation was sought by Councillor Harding by virtue of: Regulation 2(2)(a) – no fewer than half of the members of the relevant authority by which the business was to be considered had an interest which related to that business; Regulation 2(2)(d) – the nature of the member’s interest was such that the member’s participation in the business to which the interest relates would not damage public confidence in the conduct of the relevant authority’s business. Regulation 2(2)(e) the interest is common to the member and a significant proportion of the general public; and Regulation 2(2)(f) the participation of the member in the business to which the interest related to was justified by the member’s particular role or expertise. The Committee was advised that if it was minded to grant Councillor Harding’s request it would also need to determine the duration of that dispensation. The Legal Services Manager highlighted that there was no evidence to indicate that Regulation 2(2)(a) was applicable in this case. The Committee referred to the information within the dispensation request which indicated that the applicant had greater knowledge of legislation relating to the use of vehicles on public highways, to which the subject matter related to. Accordingly, based on the information available, the Committee indicated that it would be appropriate to allow the applicant to speak and make written representations at an imminent meeting of the community council but not vote, and that the duration of the dispensation be granted until the date of the next meeting of the Standards Committee, which was currently scheduled for 25 November 2025. It was noted that Councillor Caunt could submit a further dispensation request with additional information to the Committee, should further discussion on the matter be required within the community council in future. Following a discussion it was UNANIMOUSLY RESOLVED that dispensation be granted under Regulations 2(2)(d), 2(2)(e) and 2(2)(f) of the Standards Committees (Grant of Dispensation) (Wales) Regulations 2001 to Councillor Keith Harding to speak and make written representations but NOT vote on council business at meetings of St Ishmael Community Council regarding matters pertaining to access to the beach at Ferryside and the dispensation be valid until the date of the next meeting of the Standards Committee [currently scheduled for 25.11.2025].

It was reported that a dispensation was sought by Councillor James by virtue of: Regulation 2(2)(d) – the nature of the member’s interest was such that the member’s participation in the business to which the interest relates would not damage public confidence in the conduct of the relevant authority’s business; and Regulation 2(2)(f) the participation of the member in the business to which the interest related to was justified by the member’s particular role or expertise. The Committee considered a report on the code of conduct training session held for Town and Community councillors on the 10th July 2025. In accordance with previous decisions of the committee, only 1 session was held, which took place remotely via Zoom and delivered by officers within the Legal department. A total of 49 delegates indicated an intention to attend the session, of which 32 could be positively identified as doing so. It was noted that the session was recorded, and the link provided to all councils along with copies of the training materials which enabled councillors who were unable to attend the session to watch it in their own time. The Committee extended its gratitude to the Head of Legal Services and his colleagues for the provision of an informative, interesting training and professional training course. UNANIMOUSLY RESOLVED that the report be noted.

RESOLVED that: 12.1 the Code of Conduct Data gathered in respect of Town and Community Councils be noted; 12.2 Reminder letters be issued to the councils who had failed to respond to the 2024/25 survey; 12.3 Written representations be made to Cwmamman Community Council expressing the Committee’s disappointment in its failure to provide the Council with the requested data for a period of 3 years. 12.4 Written representations be made to community councils providing further information to increase awareness of the Civility and Respect pledge and encourage councils to sign up.
The Committee received a report in respect of the annual exercise undertaken between May and July 2025 to collate code compliance data from Town and Community Councils. The Committee was advised that a total of 58 responses had been received from the 72 councils asked to provide data. It was noted that a further 3 councils had submitted the information following closure of the survey and therefore these were not included within the analysis of the survey. The Committee reviewed the analysis of the survey responses for the reporting period along with comparative figures from previous years in respect of complaints, dispensation applications, declarations of interest, Code of Conduct training, training plans and the Civility and Respect pledge. Overall, the available data suggested that Town and Community councillors in the County had a good awareness of the code of conduct and generally complied with the provisions therein. While the report indicated that two councils had consistently failed to respond to the survey over the last 3 years, the Legal Services Manager clarified that one of those had since submitted a late response. It was noted that there had been a reduction in the number of code complaints compared with last year and there was no obvious correlation between code complaints and the other categories of data that had been collected. Committee members confirmed to the Legal Services Manager that they were satisfied with the content of the survey questions going forward, together with the presentation of the information set out within the report which was considered to be clear and comprehensive. UNANIMOUSLY RESOLVED that: 12.1 the Code of Conduct Data gathered in respect of Town and Community Councils be noted; 12.2 Reminder letters be issued to the councils who had failed to respond to the 2024/25 survey; 12.3 Written representations be made to Cwmamman Community Council expressing the Committee’s disappointment in its failure to provide the Council with the requested data for a period of 3 years. 12.4 Written representations be made to community councils providing further information to increase awareness of the Civility and Respect pledge and encourage councils to sign up.

RESOLVED that the annual report be noted.
The Committee received for consideration the Public Services Ombudsman for Wales (PSOW) annual report which detailed the Ombudsman’s activities during 2024/25. The report addressed code of conduct complaints, maladministration complaints and initiative investigations carried out by the PSOW during the reporting period. In this regard the Legal Services Manager reported that the latter two areas of activity fell outside the remit of the Standards Committee. In considering the report, the Committee was informed that while the number of code of conduct complaints against Carmarthenshire Council members was relatively high, none of these had been upheld or had resulted in any action. The Committee welcomed the recommendations emanating from the PSOW independent review whereby the political affiliation of the Accused Member would no longer be recorded on the pre-assessment and assessment documentation and furthermore, the PSOW had resolved to revert to its previous practice of notifying the Accused member of the complaint once it is received. UNANIMOUSLY RESOLVED that the annual report be noted.
