RESOLVED to retire into private session to receive legal advice pursuant to Paragraph 16 of Schedule 12A to the Local Government Act 1972. Having regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the Statutory Guidance issued by the DCMS and Home Office identified in the agenda item, and those to which the parties had referred it, it was: UNANIMOUSLY RESOLVED, having considered all the evidence before it, that the application for the variation of the premises licence be granted on the terms and conditions agreed between the applicant and the Responsible Authorities. In coming to its decision, the Sub-Committee made the following findings: 1. The premises have been licenced since 2005. 2. In that time, the premises have been issued with 6 warning letters, most recently on the 22nd July 2026. 3. No complaints or referrals have been received by the Licensing Authority regarding the premises. 4. The premises is in a street identified in the current statement of Licensing policy as a Cumulative Impact area and a Crime and Disorder hotspot. 5. None of the Responsible Authorities objects to the application. 6. The Applicant has agreed to all the additional licence conditions proposed by the Responsible Authorities. 7. No local residents have objected to the application. The Sub-Committee attached weight to the views of the Responsible Authorities and recognises that the Police and Public Health services are the primary sources of evidence in respect of the Licensing objectives relating to Crime and Disorder and Public Nuisance. The Sub-Committee noted that its decision must be based upon real evidence placed before it. Concerns and fears about what might happen if the application, if not supported by such evidence, are not relevant considerations. In the absence of any real evidence to suggest that granting the application would undermine the Licensing objectives, the Sub-Committee considered that it is obliged to follow the representations made by the Responsible Authorities and grant the application, subject to the terms and conditions agreed between the Applicant and Responsible Authorities. Based on the evidence presented, the Sub-Committee were satisfied that granting the application would not undermine the Licensing objectives and that the terms and conditions agreed by the Applicant were appropriate and proportionate.
No declarations of personal interest were raised.

The Legal Services Manager briefed all present on the meeting procedure, which had been convened to consider an application to vary a premises licence received from Chick King of 32 Lammas Street, Carmarthen, SA31 3AL. The application received sought to facilitate the following variations to the licence: • Reduce Late Night Refreshment hours on Thursday to 23:00 - 00:00 and Friday to 23:00 - 01:00. • Increase Late Night Refreshment hours on Saturday, Bank Holidays, Boxing Day and New Year's Eve to 23:00 – 04:30. • Remove the requirement for door-persons on Friday.
