RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A to the Local Government Act 1972. Having had regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the guidance issued by the DCMS and the Home Office, it was: UNANIMOUSLY RESOLVED having considered all the evidence before it, that the application as amended be granted subject to the following: a) the supply of alcohol to end at 23:00hrs b) the premises to close at 23.30hrs c) the conditions set out on pages 9-10 of the addendae to the agenda (as agreed by the applicant and Public Health Services) d) the conditions 1-22 set out on pages 131-133 of the agenda. In coming to its decision, the Sub-Committee made the following findings of fact: a) a reduction of the hours and the conditions agreed and imposed are appropriate to promote the licensing objectives; b) there are therefore exceptional circumstances demonstrated such that the granting of the application as above will not add to the cumulative impact in Nott Square, King Street and Queen Street, Carmarthen. The Sub-Committee was therefore satisfied that its decision (outlined above) is appropriate to promote the licensing objective.

The Chair and Solicitor briefed all present on the procedure for the meeting which had been convened to consider an application received from 62 King Street, Carmarthen, SA31 1BA for the grant of a premises licence. The Sub-Committee was advised that the applicant had subsequently amended the application to remove live and recorded music; and to cease the supply of alcohol at 00:00hrs (on all days apart from Sundays where supply of alcohol to cease at 23:00), with 30 minutes drinking up time. The Sub-Committee noted that the following documentation was appended to the report: - • Appendix A - Copy of the application. • Appendix B – Licensing Authority representations. • Appendix C - Public Health Services representations. • Appendix D – Dyfed Powys Police representations. • Appendix E - Other persons representations. It was noted that the remaining Responsible Authorities had not made representations in respect of the application. Further to the applicant’s removal of live and recorded music from the application, updated representations from Public Health Services had been circulated to the Sub-Committee in advance of the meeting. It was confirmed that conditions proposed by Public Health Services had been agreed by the applicant as set out on pages 9-10 of the Addendae to the Agenda. The Licensing Lead referred to his written representations set out at Appendix B to the report, detailing information regarding the application and his response thereto, having regard to the relevant sections of the Statutory Guidance and the Council’s Local Licensing Policy. The Licensing Lead concluded that, taking account of the representations received, in addition to the Cumulative Impact Assessment with its supporting evidence, raised serious questions as to whether it would be appropriate to grant the application. The Sub-Committee and all parties present were afforded the opportunity of questioning regarding the representations made. The Dyfed Powys Police Representative provided representations to the Sub-Committee as detailed within Appendix D to the report. The Dyfed Powys Police Representative outlined the police’s objection to the application as the premises falls within the cumulative impact area, The police’s representations included a set of conditions which the police believed to be necessary and appropriate to promote the licensing objectives should the Committee support the application. The Sub-Committee and all parties present were afforded the opportunity of questioning regarding the representations made. A representative on behalf of Carmarthen Town Council who had provided representations to the Sub-Committee as detailed within Appendix E to the report was present and was afforded the opportunity to provide oral representations to the Sub-Committee. The Sub-Committee and all parties present were afforded the opportunity of questioning regarding the written representations provided. The Committee also received oral representations from the applicant’s representative and the applicant. Reference was made to the representations and objections received and the applicant’s response thereto. The applicant’s representative concluded that: • the premises would provide a setting which focussed on quality dining; • the redevelopment of the long-term vacant property would support local regeneration, create new employment opportunities and enhance the visual and social environment; • the application had been revised in respect of its operating hours and licensable activity in an endeavour to alleviate the concerns raised. The Sub-Committee and all parties present were afforded the opportunity of questioning regarding the representations made. The Sub-Committee thereupon: UNANIMOUSLY RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A to the Local Government Act 1972.
