RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12 to the Local Government Act. Having had regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the guidance issued by the DCMS and the Home Office in the agenda item, and those to which it had been referred by the parties it was: UNANIMOUSLY RESOLVED, having considered all the evidence placed before it, that the application should be granted subject to the licence conditions agreed between the Responsible Authorities and the Applicant. In coming to its decision, the Sub-Committee made the following findings: • The premises is currently licensed and has been since 2005. • During 2025 the applicant submitted several Temporary Event Notices (TENS) extending the operating hours of the premises. There had been no complaints notified to the Licensing Authority in relation to those TENS. • There had been only 1 complaint about the premises to the Licensing Authority in the last 3 years. • In the last 3 years the Licensing Authority had received 3 referrals about the premises from other Responsible Authorities • The premises is in an area identified in the Council’s statement of Licensing policy as a crime and disorder hotspot. • The Police and Public Health services had requested that additional conditions be added to any Premises Licence that may be granted. The applicant had agreed to these conditions. • None of the Responsible Authorities have objected to the granting of the licence. In coming to its decision, the Sub-Committee attached weight to the views of the Responsible Authorities, and in particular that they did not oppose the granting of a licence, provided the agreed additional conditions be attached to it. Whilst acknowledging the heartfelt and genuine concerns expressed in the representations from residents, the Sub-Committee noted the clear legal precedent that concerns and fears about what might happen, where not supported by real evidence, were not matters that the Sub-Committee could consider. Having carefully considered all the information placed before it, the Sub-Committee believed that the residents’ concerns and fears were not supported to any significant degree by real evidence and that this was in any event insufficient to outweigh the views expressed by the Responsible Authorities. On balance therefore the Sub-Committee determined that to grant the premises licence, subject to the agreed additional licence conditions, would not undermine the Licensing Objectives and that those conditions were an appropriate and proportionate response to the issues identified in the representations received by the Licensing Authority in relation to this application.
