RESOLVED to retire into private session in order to receive legal advice pursuant to Paragraph 16 of Schedule 12A to the Local Government Act 1972. Having had regard to the relevant paragraphs of the Licensing Authority’s Statement of Licensing Policy and the guidance issued by the DCMS and the Home Office, it was: UNANIMOUSLY RESOLVED having considered all the evidence before it, that the application for the variation of the premises licence be granted subject to the additional control measures agreed between the Applicant and the Police and Public Health Services. In coming to its decision, the sub-committee made the following findings: • The premises is already licensed and has been since 2023; • Neither the Police nor Public Health Services object to the proposed extension of operating hours until midnight on Fridays and Saturdays; • The Applicant has agreed to the additional control measures requested by the Police and Public Health Services. In coming to its decision the sub- committee attached weight to the views of the Police and Public Health Services. Whilst recognising the representation received from a member of the public, the committee was mindful that legally, concerns and fears about what might happen if the application were granted, which were not supported by real evidence, were not matters that it could take into account. The sub-committee noted that no additional evidence had been placed before it to support those concerns and fears or to demonstrate that the views of the Police and Public Health services are wrong. On balance therefore the sub-committee was satisfied that to grant the application subject to the additional control measures proposed by the Police and Public Health Services would not undermine the licensing objectives and that those additional control measures were a proportionate response to the extension of the operating hours.
