RESOLVED to retire into private session pursuant to Paragraph 16 of Schedule 12A of the Local Government Act. Having regard to relevant paragraphs of the Licensing Authority’s Statement of Licensing policy and of Guidance issued by the DCMS and Home Office identified in the agenda item, and those to which it had been referred by the parties, it was: UNANIMOUSLY RESOLVED that, having considered all the evidence placed before the Sub-Committee, the application for a premises license for Llanelli Central East Premier Inn, Pemberton Business Park, Llanelli, SA14 9BD be granted on the terms and conditions agreed between the applicant and the police. In coming to its decision, the sub-committee made the following findings of fact: • The premises already has the benefit of a Premises Licence • No evidence has been presented of any crime and disorder or public nuisance associated with the operation of the premises. • The new licence will reflect physical changes to the premises • Whilst the Police have made representations, they did not object to the granting of the application on prevention of crime and disorder grounds. • No objections had been received from the other responsible authorities • The applicant agreed to the additional control measures requested by the police. In coming to its decision, the committee attached weight to the views of the police who did not recommend that the application be refused. The committee also noted that concerns and fears about what might happen if the application is granted, which were unsupported by real evidence, were not matters which it could properly consider. The committee recognised that it must not duplicate other statutory regimes and that issues relating to development control were not matters that it should consider. Whilst recognising that the concerns expressed by the local councillor were genuine and heartfelt, the committee was obliged to consider the application in accordance with relevant legislation and statutory guidance. Issues of need were not relevant. This meant that the committee should only refuse the application if it was satisfied on the balance of probabilities that to grant it would undermine one or more of the licensing objectives. No real evidence was provided to the committee to outweigh the views of the of the Police or show that the other Responsible Authorities were wrong in not objecting to this application. Accordingly, the committee was satisfied that to grant the application, as amended by the agreement between the applicant and the Police, would not undermine any of the licensing objectives and that the proposed additional licence conditions accepted by the applicant were appropriate to promote those objectives.
