Present Responsible Authority: Bryony Harper (Pollution Control) The Application A Temporary Event Notification (TEN) was received on 17th June 2025 from Caroline Munro for authorisation of a temporary event at Kings Road Yard & Dance Hall, 183a Kings Road, Pontcanna, Cardiff. The notification was in respect of an event due to take place between 17:00 and 23:30 on Saturday 19th July 2025. The notification sought to allow the following licensable activities: (i) The sale by retail of alcohol for consumption on the premises The nature of the event was described as a ‘Celebration party’. The maximum number of persons attending the event at any one time, in accordance with the temporary event notice was 70. Pollution Control issued an objection notice to the Temporary Event Notice. Pollution Control considered that holding the event would lead to the undermining of the Prevention of Public Nuisance licensing objective. A copy of the objection notice was appended to the report. Responsible Authority Representation Bryony Harper of Pollution Control was invited to address the Sub Committee. Members were advised that the premises were located in a residential area and had been the subject of repeated noise nuisance complaints. Bryony Harper listed series of complaints received since 8th March 2025. On 10th May 2025 noise nuisance from amplified music and noise from patrons was witness by officers from Pollution Control. An Abatement Notice was subsequently served on 23rd May 2025. Officers met with the licensee on site on 12th June 2025. The licensee was advised to seek professional advice from an acoustic technician regarding possible mitigation measures that can been undertaken. The officer indicated that no communication has been received from the licensee since that visit. The officer commented that that communication with the licensee is difficult as they are hard to reach and they will not respond. A temporary event then took place on 20th June 2025. Officers attended a nearby residential property and witnessed a breach of the Abatement Notice from loud amplified music and noise from patrons. Bryony Harper considered that the licensee had demonstrated a failure to comply with their statutory obligations and that granting further Temporary Event Notices would undermine the regulatory framework. Members were requested to refuse the Temporary Event Notice and issue a counter-notice in order to protect the local community. A Member asked whether there was an intention to prosecute the licensee for breaching the Abatement Notices. The officer stated that the matter was currently under review. Members were also advised that when officers attended the most recent event they attempted to speak with the DPS regarding the noise levels. However, the DPS was said to be ‘highly intoxicated’ and, therefore, officers were unable to discuss the matter. RESOLVED – That the Sub Committee issue a counter notice preventing the Temporary Event Notice from having effect. The Sub-Committee considered the TEN and all the committee papers, the statutory guidance made under section 182 of the Licensing Act 2003 and the Council’s Statement of Licensing Policy. Members also considered the written submissions made by Pollution Control, along with the oral evidence given by Pollution Control during the hearing.
