RESOLVED – That: (1) the Committee endorse the Statement of Principles for Gambling; (2) the policy be presented to Council for approval.
The Committee received a report requesting Members to consider endorsing the publication of the Council’s Statement of Principles for Gambling for the triennial period 2025 to 2028, and to forward the policy to Council for final approval. Members were advised that other than minor administrative changes, there are no proposed changes to the policy since the last time it was reviewed. The Gambling Commission is the unified regulator for gambling in Great Britain and it is responsible for granting operating and personal licences for commercial gambling operators. However, the responsibility for licensing land-based premises, as well as functions in relation to issuing permits and regulations, rests with local authorities. The Gambling Commission issues statutory guidance on the way local authorities are to exercise their functions under the Gambling Act 2005 (the Act). The Council must publish a Statement of Principles for Gambling, concerning the regulation and decision-making process relating to gambling premises in Cardiff, on a triennial basis. The approval of this policy is a Council function. The report highlighted a number of proposed legislative changes to the Gambling Act 2005. Members were asked to note that these changes will be introduced through six statutory instruments (regulations) which will be laid before Parliament. It has not been confirmed when these legislative changes will be made; however, it is expected that they will be introduced over the next couple of years. Since the last review the authority has issued three new Betting Premises Licences, one new Bingo Premises Licence, one Adult Gaming Centre Premises Licence and one new Family Entertainment Premises Licence. Six Betting Premises Licences were cancelled during the period. A public consultation exercise was carried out requesting views on the existing policy. One response was received from GamCare, an organisation supporting problem gamblers. The GamCare response was appended to the report. Members were advised that officers responded to GamCare and requested National Gambling Helpline data relevant to Cardiff. GamCare provided the local data and requested that the data not be published or used externally. Officers reviewed the response and the subsequent data provided by GamCare but did not feel there was sufficient evidence that would justify amending the Statement of Gambling Principles. Responding to a question from the Committee, the Licensing Manager stated that the Policy did not collect data in relation to problem gambling in young people aged 18 to 24. A Member raised concerns regarding sponsorship of local sports teams by betting companies and asked whether the Policy should include guidance on this. The Licensing Manager agreed to reflect on this further but the authority was not aware of any such sponsorship. The Licensing Manager also considered that any sponsorship of children’s teams would contravene the safeguarding licensing objective. RESOLVED – That: (1) the Committee endorse the Statement of Principles for Gambling; (2) the policy be presented to Council for approval.
