RESOLVED – That: - Members commend the updated Cumulative Impact Assessment for it be approved by Council prior to its publication.
The Committee received a report asking it to commend the updated Cumulative Impact Assessment for it be approved by Council prior to its publication. The Chair requested Dan Cook, Licensing Team Manager, Shared Regulatory Services, to present the report. Members were advised that in accordance with Section 5A of the Licensing Act 2003, the Licensing Authority may publish a Cumulative Impact Assessment (CIA) to help limit the number or types of licence applications granted in areas where there was evidence to show that the number or density of licensed premises in the area was having a cumulative impact and leading to problems which were undermining the licensing objectives. CIAs related to applications for new premises licences, new club premises certificates as well as applications to vary existing premises licences and club premises certificates in a specified area. Once a CIA was introduced it had to be reviewed every three years. If the licensing authority remained of the opinion that a CIA was required, they were required to publish a statement to that effect setting out why they were of that opinion. Cardiff Council last published a CIA in 2020. The policy was reviewed in 2023 and a report was presented to the Licensing Committee at their meeting on 25 October 2023 outlining the details of that review and seeking approval of a new draft CIA. This report notified the Committee of the responses to the consultation and to seek approval of the updated CIA in order for it to be published, subject to approval by Council. Members heard that 2 responses had been received: 1 from Poppleston Allen solicitors querying the inclusion of Stuttgarter Strasse on the map despite it being removed from the cumulative impact area, this was agreed by officers and the map updated to remove Stuttgarter Strasse; and 1 from Nick Newman on behalf of the Cardiff Licensees Forum, which supports the intention to publish a CIA but feels the document should better highlight the improvements within the nighttime economy in recent years. Officers reviewed this but did not consider it necessary to amend the CIA due to the relatively narrow scope of the policy. During the consultation period, the Home Office issued a revised version of the statutory guidance issued under Section 182 of the 2003 Act. Officers reviewed the revised guidance and did not consider any further amendments necessary. The Chair invited comments or questions. Members were advised that it was not possible to know how many potential applicants had decided not to proceed with their applications due to legal advice regarding the policy. Anecdotal evidence suggests that there has been a move away from large nightclubs selling large quantities of alcohol towards smaller venues providing table service. The Committee was advised that if a business takes over premises that already has a licence, this would fall outside the policy which only covers new premises licences. Members discussed the need for noise pollution to be assessed according to the housing within an area, noting problems can arise where there is new housing near to already established licensed premises. Officers advised that every application has to be assessed for Environmental Health and if there was well-established premises prior to the construction of new housing that this would be taken into account. The make-up of areas changes over time but the policy only applies where there is a substantial change such as a variation of licence. Members were advised that where a business ceases trading in licensed premises, the premises remain licensed until the licence is surrendered. If a new business wishes to trade in premises where a licence has been surrendered, the application would be presented to the Licensing Committee to determine. RESOLVED – That: - Members commend the updated Cumulative Impact Assessment for it be approved by Council prior to its publication.

Rhaid i gynghorwyr ddweud pan fydd ganddyn nhw gysylltiad personol â rhywbeth sy'n cael ei drafod, fel swydd, eiddo neu aelod o'r teulu. Mae buddiant sy'n rhagfarnu yn ddigon cryf i'r cynghorydd adael yr ystafell fel arfer a pheidio â chymryd rhan.
Caiff datganiadau eu darllen o'r cofnodion unwaith y byddan nhw wedi'u cyhoeddi.
