Applicant Representations Mr Alex Green was invited to present the application. Members were advised that Valiant Plc were experienced operators who managed 35 premises. The applicants were seeking to extend the hours of operation by 1 hour in the morning. The application was driven by demand from customers. A nearby public house opens at 0800 hours and serves alcohol from 0900 hours. Early opening was said to be popular with shift workers and more mature men. There was no anti-social behaviour associated with morning opening and Members were asked to note that no representations had been received from South Wales Police. Mr Green addressed the representations received from local ward Councillors. Whilst it was accepted that there are issues in the vicinity, Mr Green considered that most of the concerns raised were general societal issues and no evidence of a link to the premises was presented. Other Persons Representations Cllr Wild addressed the Sub Committee. Cllr Wild stated that the premises was locating within the most deprived ward in Wales. There were serious concerns regarding crime and public safety. The street scene is chaotic and this is being fuelled alcohol and drug related anti-social behaviour and violence. There are residential areas and schools nearby and the local councillors have been working with South Wales Police to reduce the availability of alcohol. Dispersal orders have also been applied in the area. Cllr Wild considered that extending the hours that alcohol is available was likely to exacerbate problems of anti-social behaviour and crime in the area. Members were, therefore, respectfully asked to consider refusing the application. Summing Up Mr Green stated that the Sub Committee’s determination of this matter must be evidence based. There were no objections received from any responsible authority. Mr Green accepted the concerns raised by the local Councillors but the premises would be well-managed and would appropriate conditions in place to promote the licensing objectives. RESOLVED: That the Sub-Committee having considered all the information, and in accordance with the requirements of the Licensing Act 2003, the Section 182 Guidance and the Licensing Authority’s own Statement of Licensing Policy, GRANTED the application. The applicant applied for the following: (1) Description of the nature of the variation (as stated by applicant): “Application is made to vary the Premises Licence. The premises has had the benefit of a refurbishment which will cause works to be undertaken to both the interior and exterior of the premises. The application sought to amend the Premises Licence in respect of the following Items. 1. Hours No change is sought in relation to the licensable activities undertaken and the hours of operation at the premises. HOWEVER, it is noted that the opening hours in respect of Sunday to Thursday are the same as the hours for licensable activities and do not provide a 30 minute wind down period as is best practice. Application is therefore made to allow the premises to remain open until midnight Sunday to Thursday. 3. Licensable Activities Application is made to add the licensable activity of exhibition of films on the following hours: Sunday to Thursday - 10:00 to 23:30 Friday and Saturday - 10:00 until midnight 4. Conditions No change is proposed to the conditions or non-standard timings endorsed upon the licence”. Unless otherwise indicated the premises may currently be open to the public during the following hours and for any hours consequential to the non-standard timings: Sunday to Thursday: 09:00 to 23:30 hours Friday and Saturday: 09:00 to 00:30 hours From start of permitted hours on New Year’s Eve until start of permitted hours on New Year’s Day To provide licensable activities during the following hours: (i) The sale by retail of alcohol for consumption on and off the premises: Sunday to Thursday: 10:00 to 23:30 hours Friday and Saturday: 10:00 to 00:00 hours From start of permitted hours on New Year’s Eve until start of permitted hours on New Year’s Day (ii) The provision of regulated entertainment in the form of indoor sport: Sunday to Thursday: 10:00 to 23:30 hours Friday and Saturday: 10:00 to 00:00 hours (iii) The provision of regulated entertainment in the form of live music (indoors), recorded music (indoors): Sunday to Thursday: 10:00 to 23:30 hours Friday and Saturday: 10:00 to 00:00 hours (iv) The provision of late night refreshment (indoors): Sunday to Thursday: 23:00 to 23:30 hours Friday and Saturday: 23:00 to 00:00 hours A site map showing the premises and the plans referred to above was appended to the report. At the commencement of the meeting Members were advised that the applicant had agreed the conditions suggested in the representations received from Pollution Control. Those representations were subsequently withdrawn. Applicant Representations Michelle Hazelwood presented the application. Members were advised that Marstons Plc purchased the premises in 2021 and it was formerly part of the S A Brains estate. The premises was in need of renovation and a rolling programme of investment had commenced to refurbish and modernise the premises in the region of £300,000. There were 3 elements to the application and some changes were uncontroversial. The extension of hours to allow a wind down time at the end of the evening was to allow people to disperse gradually and it was considered that this would alleviate some of the issues commented upon in the representations received from local residents. Allowing 30 minutes ‘drinking up time’ was best practice and was acknowledged across the industry. The application sought to permit films to be played both inside and externally and there also were some changes to the layout of the premises. The changes to the ground floor were minimal but aesthetically the premises would look very different. There was also some investment to be made in the function room on the first floor, including £50,000 investment in new toilet facilities. The skittle alley at the premises was to be refurbished. Members were advised that the premises was a well-known hub for skittling culture in the city and the applicants were committed to maintaining that. The premises hosts 5 teams and it is used to host local competition finals. Ms Hazelwood noted that concerns had been expressed regarding use of the external area, including the provision of a screen. Ms Hazelwood stated that the screen would occasionally display sporting events and films until 7.00pm. The screen could also display childrens entertainment during childrens parties. When sporting events were taking place there would be no commentary so volume levels were unlikely to be problematic. Although it was accepted that such events would still need to be well managed and the applicants had policies and systems in place to ensure this was the case. Responding to a question from the Sub Committee, Ms Hazelwood advised that whilst films are licensable activity and are regulated, the display of sporting events are not. The screen was a standard screen with no additional speakers for amplification. Live and recorded music was applied for but all windows and doors were to remain closed when regulated entertainment was taking place. RESOLVED: That the Sub-Committee having considered all the information, and in accordance with the requirements of the Licensing Act 2003, the Section 182 Guidance and the Licensing Authority’s own Statement of Licensing Policy, GRANTED the application. The Sub Committee heard from the applicant and listened to all the evidence and submissions and considered the written material. Members also considered the Licensing Act 2003, the Section 182 Guidance, our own Statement of Licensing Policy and all written representations. The Sub Committee noted that, prior to the meeting, the applicants agreed to the proposed conditions from Environmental Health Pollution Control in Appendix C of the report to promote the Public Nuisance licensing objective. Where there is no evidence that a Premises Licence will undermine the licensing objectives, there is a presumption to the grant the application. If there is evidence that a licensed premises is undermining the licensing objectives, the Licensing Act 2003 allows any person to apply for a Review of the Premises Licence.
