RESOLVED that for reasons contained within the Officers report the Licensing and Gambling Committee Considered the report and offered comments to Council on the revised Statement of Gambling Licensing Policy, prior to submission to Full Council on 14th January 2025.
The Licensing Manager presented a report to the Licensing and Gambling Licensing Committee which informed Members of the result of consultation carried out to review the Statement of Gambling Licensing Policy. The report sought the views of Members prior to its presentation to Council on 14th January2025. The Licensing Manager advised the Members that in accordance with the Gambling Act 2005, the Licensing Authority must prepare, consult upon, and approve a Gambling Statement of Licensing Policy which must be reviewed every three years. It was noted that the current Policy was approved by Council and published in January 2022. Members further noted that the policy must contain objectives regarding the following: - · Preventing gambling from being a source of crime or disorder, being associated with crime or disorder or being used to support crime, · Ensuring that gambling is conducted in a fair and open way, and · Protecting children and other vulnerable persons from being harmed or exploited by gambling. The Chair sought confirmation that the windows should be blocked up on adult gaming centres and asked if that was the case. It was confirmed that they should be made less appealing, the majority of those premises currently within the borough already promote this type of attitude, it had not been previously referenced in the policy, however any new applicants would be encouraged to comply with the ethos of not making the premises too attractive for children than they need to be. A Member referred to the map of the problem gambling and asked how this had been devised and how it could work in practice. The Licensing Manager confirmed that the maps were not owned by the authority , they are produced by Gamble Aware who undertake research and would be aware of prevalence should there be any issues in relation to gambling prevalence or harms on a local basis Members were advised that the number of complaints received by the licensing department are small as they would go to other professions such as the Health Board or other professions where individuals would be referred for addiction for example so the information would be forwarded to those relevant bodies Clarification was sought on whether the text highlighted red and crossed out in the report would be removed as it was difficult to read the report. The Licensing Manager confirmed that these track changes were left in to show Members of the Committee where changes had been made and what was being removed and replaced with and reassured Members that these track changes would be removed in the finalised version of the policy. A Member commented that the red text and track changes shows that there had been a lot of work by the Licensing staff to ensure that the policy had been updated correctly to ensure that the relevant updates are contained with the policy and thanked the Licensing Manager and his team for all their hard work. Members discussed the number of advertisements on both TV and social media seen regularly by children and vulnerable individuals and it was suggested that a letter be sent to the Gambling Commissioner of the TV Companies. The Licensing Manager confirmed that he would write to the Gambling Commissioner in relation to the prevalence of TV and online social media advertising of gambling on behalf of the Committee. Following consideration and discussion the report it was moved and seconded that the recommendations be approved. RESOLVED that for reasons contained within the Officers report the Licensing and Gambling Committee Considered the report and offered comments to Council on the revised Statement of Gambling Licensing Policy, prior to submission to Full Council on 14th January 2025.

The Licensing Manager presented the report which informed Members of the implementation of Part 4 of The Public Health (Wales) Act 2017 (“the Act”) which sets out requirements for a mandatory licensing scheme for practitioners carrying out ‘special procedures and approved premises / vehicles in Wales. The Licensing and Gambling Committee noted that the Public Health (Wales) Act 2017 (“the Act”) received Royal Assent on 3 July 2017. Part 4 of the Act sets out the requirements for a mandatory licensing scheme for practitioners carrying out ‘special procedures’ in Wales. ‘Special Procedures’ include practices such as tattooing, body piercing, acupuncture, and electrolysis. The Members further noted that the intention of the licensing scheme is to improve and sustain standards of infection prevention and control in the special procedures industry and assure the safety and health of clients and practitioners. Part 4 comes into force on 29th November 2024. After this date Members of the Licensing and Gambling Sub Committee may be called to hear a contested application as to whether an applicant for a special procedure licence was suitable to be issued and for the committee to determine the case. The applicant would have a right to appeal any decision by applying to the Magistrates Court that licence. Members were made aware that to assist the Licensing and Gambling Sub Committee and Officers in assessing an individual ‘s suitability, there would be a statutory guidance on the assessment of person's fitness to perform a special procedure in Wales, and this would be shared with Members as soon as is published by Welsh Government. A fact sheet headed the Public Health Wales 2017 Part 4 Special procedures information on the implementation progress would also be circulated to Members following the meeting. The Chair sought clarification on whether anyone seeking to have a Special Procedures Licence would they need to have a premises certificate even if they worked out of premises owned by someone else and moved and operated from different premises. It was confirmed that any individual seeking a Special Procedures Licence would have to ensure that there was an approved premises certificate and if they operated for other premises, they would have to provide the certificate for those premises, this would ensure that the premises had been inspected and that the individuals have the suitable measures in place to ensure that the infection control and protocols are up to date The Legal Adviser explained that this would effectively prevent people from setting up this type of activity for instance in their garden shed by making sure that they are operating from an approved premises who have a certificate. The Licensing Manager agreed that this would control this type of activity where it was not being regulated and ensure that Environmental Health Officers were satisfied that individuals were competent in their craft. Clarification was sought confirmation on how the banning system would be applied. The Licensing Manager confirmed that Officers were awaiting the guidance document in relation to individuals’ fitness which would assist Officers in preparing the reports and assist Members in determining the suitability of individuals on each case-by-case basis when determining the application. A Member queried whether individuals that currently work in this type of work would be informed of the changes that would be coming into force. The Committee were advised that there had been extensive consultation undertaken in Wales in relation to the new special procedures legislation across all areas affected and that environmental Health Team had been sending out the Public Health Wales fact sheets and newsletters over the last year to all those practitioners which also included body piercing, electrolysis and acupuncture individuals who have their own trade bodies. Those bodies would also provide the information to their members of their organisations in relation to the existing ones in Caerphilly setting out that they would need a transitional licence and within nine month period complete the process and make an application under the new regime and have a practitioner licence and an approved premises. A comment was made that this would increase fees for those practitioners and confirmation was sought on whether there had been any feedback from anyone on this. The Licensing Manager confirmed that the initial scheme the original position was a one-off registration fee, the licence fee would now be renewed on a three-year cycle for each of the practitioners and those fees had been circulated to practitioners in advance so there is an awareness. The Chair enquired as to whether this would not this would apply to Botox injections or lip fillers. It was confirmed that those practices would not come under this but there was scope under the Act in the future that new procedures in the future could be implemented. A Member referred back to agenda item 3 and commented that Aneurin Bevan Health Board had provided their comments and asked if the Health Board had any comments on this legislation. The Licensing Manager confirmed that consultation was not conducted by the Council it had been done more widely by Welsh Government and assured members that the health professionals had an input into the consultation and also confirmed from attending various panels and groups as a consultee, infection prevention and control was the main goal as was that of the Councils environmental health colleagues. Assurances were given that this was not Caerphilly specific, this was Wales specific and that there had been conversation and that the health professionals had been fully involved in the preparation of the new legislation being introduced. Following consideration and discussion the report it was moved and seconded that the recommendations be approved. RESOLVED that for reasons contained within the Officers report the content of the report in advance of the implementation of a mandatory licensing requirement for Special Procedures Practitioners and Approved Premises / Vehicles be noted. The Chair thanked everyone in attendance and the meeting closed at 3.20pm.
