The Chairman opened the meeting and introductions were made. The Legal Advisor outlined the procedure for the meeting and reported that Members had previously familiarised themselves with the report of the Licensing Manager, the application and plan of the premises together with the written submissions from Responsible Authorities and Local Residents who were objecting to the application. The Licensing Manager presented the report which outlined the application submitted for a new premises licence in relation to Blackwood Golf Club. The sub committee’s attention was drawn to section 1.3 of the report which outlined the proposed trading times and licensable activities and 1.3.1 of the report which highlighted the steps that the applicant had offered in their operating schedule to enable them to promote the licensing objectives. The Licensing Manager then referred to representations received in relation to the application from the Responsible Authorities and Other Persons i.e. Local Residents that were set out within the report at 1.5. to 1.5.2. Copies of which were circulated with the agenda. Attention was then drawn to the local policy considerations as set out at 1.6 within the report and to the way in which the Sub Committee should deal with the application. It was explained that the Sub Committee must have regard to the Licensing Objectives, Section 182 Home Office Guidance and the council’s own statement of licensing policy, the information in the report and the representations made and to the evidence heard at the meeting. The Chair invited the applicant to make their submissions. Mr S. Jones representing Blackwood Golf Club, addressed the Sub Committee and explained the reason that the application had been submitted was due to the Club Premises Certificate that is currently held by the club is outdated. Mr Jones, assured Members that the club does not intend on changing the fundamental use of the club. The applicant further assured Members that since submitting the application and receiving a visit from Environmental Health boundary walks of the club have been undertaken and doors and windows have been kept closed when any live music events have taken place, to mitigate any potential noise issues, in line with the guidance received. Heddlu Gwent Police addressed the Sub Committee, confirming that they had no objection to the application. They were satisfied with the conditions that have been agreed with the applicant. There were no questions for the Police. Representations were then invited from the Assistant Licensing Manager on behalf of the Licensing Authority in its role as a responsible authority. The Assistant Licensing Manager addressed the Sub Committee confirming that that they supported conditions proposed by the fellow responsible authorities. However, the Officer recognised there was a potential issue with the proposed closing time and the terminal hour for the sale of alcohol as they were both the same time. The Officer advised the Sub Committee that within the Licensing Policy it advocates a 30-minute wind down period. The Officer confirmed that the applicant has agreed to bring back the terminal hour for the sale of alcohol by 30 minutes to allow for this wind down period. All parties were afforded the opportunity to ask questions of the Licensing Authority. The Local Ward Member representing the local residents sought clarification on the times that were now being proposed. The Officer confirmed the times that the applicant had agreed to were the sale of alcohol on Friday and Saturday until 00:00 closing the club at 00:30. The Environmental Health Officer addressed the Sub Committee and referred to their representations. The Officer felt that the conditions which had been agreed by the applicant prior to the meeting would mitigate any potential noise nuisance. The Officer, assured Members that the club will be monitored, and should the need arise Environmental Health would work with the club in the future. All parties were afforded the opportunity to ask questions of the Environmental Health Officer. The Local Ward Member sought further clarification on the permitted times which he understood to be Monday to Thursday from 12:00noon to 23:00 and Friday and Saturday from 11:00 to 00:00 midnight with closing at 00:30. The Councillor confirmed that if this was the case there would be no objection from the residents. The local resident addressed the Sub Committee confirming that in light of the clarification with regards to the hours that the applicant has agreed to, he now has no objection to the closing times and would support the terminal hour for the sale of alcohol on New Years Eve being 00:30. The Sub Committee thanked the responsible authorities for their submissions and then called upon Local Ward Member Councillor N. Dix to address the Sub Committee on behalf of the local residents. Councillor Dix advised the Members, that due to the clarification that was sought earlier the residents would have no objections to the proposed permitted times for the sale of alcohol and the closing time of the club. The Councillor also stated that providing the conditions were adhered to with regards to the boundary checks and the doors and windows being closed during times of amplified music, then there were no further objections to this application being granted. The Chair thanked all parties for their representations and parties were invited to sum up before the Sub Committee considered the application. The Licensing Manager addressed the Sub Committee and drew attention to the application submitted and for clarification purposes explained that the application sought to provide the sale of alcohol on New Years Eve until 00:30 and close at 01:00. The Licensing Manager advised the Members that when determining the application, they should take into consideration the Licensing Act, the Guidance, and the local licensing policy and also all the comments that had been presented to them. Heddlu Gwent Police confirmed their position that the Police were satisfied that the applicant had agreed to the additional conditions prior to the meeting and therefore, had no objection to this application. The Assistant Licensing Officer confirmed their position, that they have no objection to the licence being granted. Also, further to the earlier comments from the local resident they would not be averse to New Years Eve permitted alcohol sale until 00:30 and closing at 1:00. The Environmental Health Officer also confirmed that they were satisfied that the applicant would implement the conditions agreed and therefore would have no objection to the application being granted. The Legal Advisor informed all parties present that the Sub Committee would retire to consider the representations made at the meeting and they would be informed in writing of the decision in the next 5 days. The Sub Committee retired at 10:40am to make its decision and all other parties left the meeting. Rhaid i gynghorwyr ddweud pan fydd ganddyn nhw gysylltiad personol â rhywbeth sy'n cael ei drafod, fel swydd, eiddo neu aelod o'r teulu. Mae buddiant sy'n rhagfarnu yn ddigon cryf i'r cynghorydd adael yr ystafell fel arfer a pheidio â chymryd rhan.
Caiff datganiadau eu darllen o'r cofnodion unwaith y byddan nhw wedi'u cyhoeddi.
Dyw'r cyngor ddim wedi cofnodi presenoldeb ar gyfer y cyfarfod hwn.
Yn rhestru cynghorwyr presennol y cyngor yn unig. Nid yw aelodau cyfetholedig, swyddogion a chyn-gynghorwyr yn cael eu dangos.
