Retention of 14 no. apartments (Use Class C3) within the existing public house (Use
Class A3) and 2-storey side extension (all approved under LPA Ref:
2019/1062/FUL), together with change of use of ground floor and remainder of first
floor of existing public house (Use Class A3) to provide 8 no. apartments (Use Class
C3), external alterations, repositioned vehicular access, provision of 15 no. car
parking spaces, cycle storage, bin storage, drainage and ancillary works.
The application had been called in for determination by Planning Committee by
Councillor Collins if officers were minded recommending approval. The reason for
the call in being that the application would result in the loss of a community facility
which had been approved under previous planning approval 2019/01062/FUL.
Following consideration of the application, and in the absence of unanimity among
Members, a vote was taken on a motion to defer consideration of the application
pending a site visit. The proposed visit would include both internal and external
inspections of the site to enable Members to fully assess the application. It was also
requested that a further report be presented to a future meeting, including setting out
potential reasons for refusal together with Planning officers' recommendations and
other points raised at this meeting. The vote was recorded as follows:

ii) storage of plant and materials used in constructing the development;
iii) measures to control and mitigate the emission of dust, smoke, other
airborne pollutants and dirt during construction;
iv) a scheme for recycling/disposing of waste resulting from demolition and
construction works.
v) hours of construction;
vi) lighting;
vii) management, control and mitigation of noise and vibration;
viii) how the developer proposes to accord with the Considerate Constructors
Scheme (www.considerateconstructorsscheme.org.uk) during the course of
the construction of the development; and
ix) a system for the management of complaints from local residents which will
incorporate a reporting system.
The construction of the development shall be undertaken in accordance with
the approved CEMP.
Reason:
To ensure that the construction of the development is undertaken in a
neighbourly manner and in the interests of the protection of amenity and the
environment and to ensure compliance with the terms of Policies SP1
(Delivering the Strategy) and MD7 (Environmental Protection) of the Local
Development Plan.
7. In the event that contamination is found at any time when carrying out the
approved development that was not previously identified it must be reported in

by the Local Planning Authority. An investigation and risk assessment must
be undertaken and where remediation is necessary a remediation scheme
and verification plan must be prepared and submitted to and approved in
writing by the Local Planning Authority. Following completion of measures
identified in the approved remediation scheme a verification report must be
submitted to and approved in writing by the Local Planning Authority. The
timescale for the above actions shall be agreed with the LPA within 2 weeks
of the discovery of any unsuspected contamination.
Reason:
To ensure that any unacceptable risks from land contamination to the future
users of the land, neighbouring land, controlled waters, property and

height, design, orientation, luminance levels and hours of operation of all
proposed lighting. The approved lighting scheme shall be implemented in full
prior to its first use and shall thereafter be retained and operated in
accordance with the approved details.

In the interests of protecting the amenities of neighbouring occupiers and to
minimise light pollution and impacts on biodiversity, in compliance with
policies SP1 (Delivering the Strategy), MD2 (Design of New Development)

The decision to recommend planning permission has been taken in accordance with
Section 38 of The Planning and Compulsory Purchase Act 2004, which requires that,
in determining a planning application the determination must be in accordance with
the Development Plan unless material considerations indicate otherwise. The

contamination which may be present, if identified as required by the desk top
study;

intended use by removing any unacceptable risks to human health, controlled
waters, buildings, other property and the natural and historical environment,
shall be submitted to and approved in writing by the Local Planning Authority.
The scheme shall include all works to be undertaken, proposed remediation
objectives and remediation criteria, a timetable of works and site management

carried out safely without unacceptable risks to workers, neighbours and other
offsite receptors in accordance with Policies SP1 (Delivering the Strategy) and
MD7 (Environmental Protection) of the Local Development Plan.

accordance with its terms prior to the occupation of any part of the
development. The Local Planning Authority must be given two weeks written
notification of commencement of the remediation scheme works. Within 6
months of the completion of the measures identified in the approved
remediation scheme, a verification report that demonstrates the effectiveness
of the remediation carried out must be submitted to and approved in writing by
the Local Planning Authority.
Reason:
To ensure that any unacceptable risks from land contamination to the future
users of the land, neighbouring land, controlled waters, property and
ecological systems are minimised, and to ensure that the development can be

proposed remediation over a period of 12 months (or another agreed
timeframe), and the provision of reports on the same must be submitted to
and approved by the Local Planning Authority, prior to the occupation of any
approved building. Following completion of the measures identified in that
scheme and when the remediation objectives have been achieved, reports
that demonstrate the effectiveness of the monitoring must be produced and
submitted to the Local Planning Authority. Timeframe for the submission of
the report(s) to be agreed with the LPA.
Reason:
To ensure that any unacceptable risks from land contamination to the future
users of the land, neighbouring land, controlled waters, property and
ecological systems are minimised, and to ensure that the development can be
carried out safely without unacceptable risks to workers, neighbours and other
offsite receptors in accordance with Policies SP1 (Delivering the Strategy) and
MD7 (Environmental Protection) of the Local Development Plan.
13. In the event that contamination is found at any time when carrying out the
approved development that was not previously identified it must be reported in
writing within 2 days to the Local Planning Authority, all associated works
must stop, and no further development shall take place until a scheme to deal
with the contamination found has been submitted to and approved in writing
by the Local Planning Authority.
Reason:
To ensure that any unacceptable risks from land contamination to the future
users of the land, neighbouring land, controlled waters, property and
ecological systems are minimised, and to ensure that the development can be
carried out safely without unacceptable risks to workers, neighbours and other
offsite receptors in accordance with Policies SP1 (Delivering the Strategy) and
MD7 (Environmental Protection) of the Local Development Plan.
