Councillor Hugh Jones, local Member, addressed the Committee and sought clarification relating to the Court of Appeal decision which indicated it was unlawful to use Section 73 of the Town and Country Planning Act. The Officer presented the report and in doing so, displayed photographs of the site to assist with his presentation. A debate ensued and the following points were highlighted: · The applicants were seeking approval for a new pedestrian crossing point which was deemed beneficial by Highways Officers as this was a minor amendment in terms of the overall appearance and didn’t give rise to the amenity of residents nearby. It was noted that as it was within the terms of the planning permission, changes could be approved. · Confirmation that previously, plans were approved for a car park to be constructed, and part of it was on Council owned land. The developers started construction. However during the search process the land had been incorrectly identified as adopted Highways rather than HRA land. Once the matter was raised, the developer stopped work and they have subsequently amended their plans. An amendment to the recommendation contained in the report was proposed and seconded that Members undertake a site visit. On being put to the vote, this amendment was lost.
