RESOLVED – (i) That the recommendation of the Appointments Panel that the successful applicant be appointed as an independent lay member to the Governance and Audit Committee for a period up to and including 24 May 2028 be approved. (ii) That Council supports that an advert goes out for the recruitment of three independent lay members of Governance and Audit Committee for the period up to 24 May 2028. Reason for decisions To comply with the statutory requirements of the Local Government (Wales) Measure 2011. The majority of members did not support the officer’s recommendation to re-appoint the lay members.
The Chief Officer Finance and ICT submitted a report COFI/19/24 which asked Council to agree the recommendation from the Members Appointment Panel for the appointment of one independent lay member, subject to references, to the Governance and Audit Committee for the period up to and including 24th May 2028 and agree to the extension of the three current Independent Lay Members to the Governance and Audit Committee for the period up to and including 24th May 2028. An amendment was proposed and seconded in the following terms: Recommendation 3.2 as worded in the report be replaced with the following wording: That Council supports that an advert goes out for the recruitment of three independent lay members of Governance and Audit Committee for the period up to 24 May 2028. During the debate a number of Members raised concerns regarding the amendment. A Member referred to the constitution and stated that the Governance and Audit Committee was a regulatory Committee independent of Council and Executive Board. It was suggested that the Committee would, by default, become a non-functioning Committee should the amendment be approved. The Chief Officer Governance and Customer confirmed that the Governance and Audit Committee would remain a functioning Committee should the amendment be approved. She further advised that the quorum of the Committee was 3 members and that the legislation did not specify if those members should be lay or committee members. The Committee could still function whilst a recruitment process was being undertaken. A second amendment was proposed and seconded in the following terms: Recommendation 3.2 as worded in the report be reinstated as follows: That Council approves the extension of the three current independent lay members to the Governance and Audit Committee for a further period up to and including 24 May 2028. In accordance with Standing Order 18(2), a recorded vote was then taken on the original recommendation 3.2 as noted in the report (the second amendment as noted above), the voting being as follows: For – Councillors Bryan Apsley, Paul Blackwell, Gary Brown, Brian Cameron, Krista Childs, Dana Davies, Mike Davies, Frank Hemmings, Corin Jarvis, Malcolm King OBE, Stella Matthews, Anthony Wedlake, Jerry Wellens, Robert Ian Williams and Derek Wright. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
