RESOLVED – That planning permission be granted, subject to the completion of a Section 106 Agreement. Reasons for decision To secure the long term management and maintenance of the on-site and off-site habitat mitigation areas.
RESOLVED – That the Chief Officer Economy and Planning be given delegated authority to grant planning permission, subject to the following, as well as the conditions set out in the Committee report: (1) The completion of an assessment under the Conservation of Habitats and Species Regulations 2017 (as amended), in consultation with Natural Resources Wales, that concludes the development is not likely to have a significant effect on the integrity of the River Dee and Bala Lake; and (2) The agreement of a scheme of mitigation measures, to include an investigation into the implementation of a residents matchday parking scheme, that would be implemented in the event that the second annual monitoring report submitted in accordance with the Travel Plan scheme of annual monitoring demonstrates that the measures set out in the Travel Plan have not secured a sufficient modal shift to offset the additional parking demand likely to arise from the development. (3) Where the measures referred to in (2) above require financial contributions, that permission only be granted following the completion of a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to secure those financial contributions, with the Chief Officer Economy & Planning be given delegated authority to determine the final form and content of the Obligation.

The Chair welcomed Alex Loven to the Meeting who spoke in favour of the application. The Officer presented the report and in doing so, displayed plans of the site to assist with his presentation. A discussion ensued and the following points were raised during the debate: · The site was within the development boundary of the Wrexham Industrial Estate and was allocated for employment development within the Unitary Development Plan. · Officers advised that the design of the proposed building was in keeping with the character of existing industrial development on the estate and that a nearby dwelling opposite the site was subject to a separate application proposing its demolition. · Members noted that submitted air quality and noise assessments concluded that the development would not have an unacceptable impact on residential amenity, subject to conditions requiring the management of air quality during construction and operational noise levels. · Officers advised that two alternative schemes had been submitted to accommodate either B2 (general industrial) or B8 (storage and distribution) uses, with differing parking and servicing arrangements. The development would be required to comply with the relevant approved layout depending on its eventual use. · It was noted that the proposed parking provision complied with adopted standards, including accessible and electric vehicle parking spaces, and that the Highway Authority had raised no objections to the proposal as the development was not expected to have a significant impact on the wider highway network. · Members sought clarification regarding the proposed ecological mitigation, including measures to ensure phosphorus neutrality and the adequacy of the off-site mitigation land. Officers advised that the development would generate approximately 2.3kg of phosphorus, but that the removal of agricultural land from production as part of the approved mitigation strategy would offset this amount, resulting in a phosphorus-neutral development. It was further advised that the mitigation proposals had been assessed and accepted by both the Council's planning policy officers and Natural Resources Wales (NRW). · A Member sought clarification regarding how Great Crested Newts would be protected and relocated during the development process. Officers advised that any necessary relocation and protection measures would be undertaken in accordance with a licence issued by NRW. · Members welcomed the proposal and recognised its economic benefits, noting that it had the potential to create between 200 and 400 jobs and bring forward a site that had long been identified for employment development. RESOLVED – That planning permission be granted, subject to the completion of a Section 106 Agreement. Reasons for decision To secure the long term management and maintenance of the on-site and off-site habitat mitigation areas.

(Members declarations of interest in relation to this item are set out in Minute 39 above) The Chair welcomed Aiden Miller to the Meeting who spoke in favour of the application. The local Member Councillor Phil Wynn addressed the Committee, along with Mark Pritchard. The Officer presented the report and highlighted the main points contained within it. A discussion ensued and the following points were raised during the debate: · Members noted that the recommendation had been amended following concerns raised by the Highway Authority regarding the practicality and effectiveness of a residents’ match-day parking scheme as a mitigation measure. · Concerns were expressed regarding the impact of match-day parking on nearby residential areas, including parking congestion, obstruction of footways, access for emergency vehicles and the effect on local residents. · Officers advised that the application related solely to the use of additional seats within the approved Kop Stand and that the Committee could only consider the additional impacts arising from the proposed increase in capacity rather than pre-existing parking and traffic issues associated with match days. · Officers advised that whilst a residents’ match-day parking scheme remained a potential option, concerns had been raised regarding its practical implementation and enforceability. It was therefore considered appropriate to secure a broader package of mitigation measures which could include additional parking provision, a park and ride service and sustainable travel initiatives, should the Travel Plan monitoring demonstrate that sufficient use of alternative transport methods had not been achieved. · Clarification was sought regarding phosphorus impacts and the requirement for a Habitat Regulations Assessment. Officers advised that further information was required before a final assessment could be completed. · Clarification was also sought regarding noise impacts arising from the additional spectator capacity. Officers advised that the submitted information demonstrated that the proposed increase in seating capacity would not result in a significant increase in noise levels and no objection had been raised by Public Protection. (Members declarations of interest in relation to this item are set out in Minute 39 above) The Chair welcomed Darren Jacks to the Meeting who spoke against the application. Councillor Brian Cameron, Local Member also addressed the Committee. The Officer presented the report and in doing so, displayed plans of the site to assist with his presentation. A discussion ensued and the following points were raised during the debate: · Officers advised that the application remained subject to a Welsh Government Direction, which prevented the grant of planning permission pending consideration of whether the application should be called in. · Officers advised that the only element of the proposal requiring planning permission was the proposed fuel storage building, as the biomass boiler and flue could be installed without planning permission. The proposed fuel storage building was modest in scale and considered appropriate within its industrial setting. · Members were advised that Public Protection Officers had reviewed the technical information submitted in support of the application, including air quality and emissions assessments, and were satisfied that the proposal would not give rise to unacceptable air quality impacts. · Concerns were raised regarding the proximity of the development to the neighbouring primary school and the potential impact of emissions on the health and wellbeing of children and nearby residents. · Clarification was sought regarding the fuel to be used within the biomass boiler. Officers advised that the proposal related to the use of untreated woodchip fuel and that any inappropriate use of the boiler would be subject to enforcement powers available under environmental legislation. · Some Members remained concerned that the information before the Committee was not materially different from that considered when the previous application was refused in January 2026. It was argued that, whilst additional technical information had been submitted, no site-specific evidence had been provided to demonstrate that the development would not have an adverse impact on the neighbouring primary school and surrounding area. RESOLVED – That planning permission be refused. Reason for decision Insufficient information has been submitted to demonstrate that the development would not give rise to unacceptable pollution. The proposed development is therefore contrary to policy GDP1(f) of the Wrexham Unitary Development Plan.
