The Assistant Licensing Manager outlined the report which is to consider revisions proposed by the Director of Public Health, Protection & Community Services to the Council’s Statement of Principles, under the provisions of the Gambling Act 2005. Members were advised that the Statement of Principles is the policy framework which sets out the expectations of the Licensing Authority in matters relevant to the Gambling Act 2005, which is to be published by 3rd January 2025 and to come into effect from 31st January 2025, pending approval. Also, that there is a statutory requirement to review the Statement of Principles on a 3 yearly basis and the current statement has therefore been subject to review. It was reported that the process for the review is very prescriptive, in that the Gambling Commission have set out in their Statutory Guidance both the format and content of the Statement of Principles. Furthermore, that whilst it is recognised that the position of respective Licensing Authorities may vary according to the local needs of their area, the format of all policy statements will essentially be the same, and this is considered to be in the interest of the trade to enable there to be effective assessment of the policy documents and ease of comparison between authorities. The Assistant Licensing Manager reported that the draft Policy will be open to comment between 15th July 2024 to 4th August 2024, and following any comments, the Policy will be further revised to incorporate any necessary changes. Also, that the further revised document will be presented before Licensing Committee together with any changes that may have been considered necessary on 10th September 2024. In addition, upon approval of the licensing committee, the Draft Statement of Policy can then be commended for final approval & adoption by Full Council towards the end of the year, which will allow the revised Policy Statement to take effect 31st January 2025, in accordance with statutory requirements. Following consideration of the report, the Committee RESOLVED; (i) To note the amendments to the draft policy as advocated by the Director of Public Health, Protection and Community Services; (ii) To note consultation of the revised policy will take place during the dates of 15th July 2024 to 4th August 2024.
